RE:    REQUEST FOR 24-HOUR STATE SECURITY

This is my formal request for round-the-clock state security in view of the recent chilling threats to me and my family including the macabre burning and burial of my effigy and coffin in a mock funeral in Nyando lead by an ODM Member of Parliament Fred Otieno Outa and the apparent endorsement of those serious and criminal threats by the top leadership of the ODM and the failure of the relevant Kenyan authorities in apprehending and prosecuting the culprits as would be required in a country governed by the rule of law.
 
Since launching my book, Peeling Back the Mask: A Quest for Justice in Kenya, on July 14, 2012, I have received several death threats and threats of serious bodily harm by short text messages and email transmissions from people I do not know. One chilling threat stated that upon my return to Kenya next month, I will be "assassinated and my kidneys eaten."
 
My family and I take these threats very seriously. We believe that the recent media attacks on me; the character assassination; the almost daily and desperate pseudo psycho-analysis; and the deliberate concoction and publication of so-called "Miguna Files" in sections of the Kenyan media, deliberate and are intended to divert attention from the serious governance issues (particularly grand corruption and nepotism in and by the Office of the Prime Minister) raised in my book, but which some powerful figures, including, but not limited to the Prime Minister of the Republic of Kenya, would rather keep hidden from public scrutiny.
 
Despite all the threats, the intimidations, the character assassinations and the daily gratuitous attacks in the media and the Internet, I shall return to Kenya on Thursday, August 16, 2012. My flight is scheduled to land at the Jomo Kenyatta International Airport at 20:15 hours. I intend to continue with my chosen work of writing about and agitating for the respect for the rule of law, the upholding of the constitution (in letter and spirit), the respect for fundamental human rights, the expansion of the democratic space, the elimination of corruption, tribalism and nepotism (of all forms and shades) and the entrenchment and practice of good governance in Kenya. In other words, I am fortified and fully committed in the quest for justice in Kenya.
 
Consequently, I hope and trust that your good offices will grant and deploy, for my protection and that of my family, 24-hour state security.
 
I would be very grateful if you can assign adequate security for me upon my arrival at the Jomo Kenyatta International Airport on the date and time specified.
 
I am forwarding this request electronically, through the Kenya Police email service, because I am currently on holiday and book tour/promotion in Canada.

I hear where ya'll are coming from and we are on the same page, as much as we all like our Chief Justice Mutunga and want him to succeed, we cannot ignore his activism background when that is clearly the basis of his elevation to head the judiciary or his gaffes since he became the head of the judiciary or discount the fact that he is inexperienced as a judge or chief justice for that matter. Activism per se is not a bad thing but like everything in life, it has it is place and time, the judiciary is not it and unfortunately we are seeing vestiges of activism begin to permeate the judiciary- that must stop, PERIOD. I want the rule of law to supersede special interests and chapter 6 appears to be the litmus test which will give us the assurance whether or not Mutunga's courts are up to the task. So far I don't see that- I see a CJ who may be in haste to stamp his authority and would most likely get it all wrong, it will be a tragedy.  I am just sounding the alarm bells of caution that we must be extremely vigilant with respect to this CJ and his courts. As Dr. Shem Ochuodho correctly pointed earlier, CJ Mutunga turned down the invitation to officiate Miguna's book launch and in the same week and breath was in a closed door meeting with Prime Minister Raila Odinga- I mean he has to know that the appearance of impropriety will be imputed against him. It was soon after this meeting that ODM held its Bomas meetings and Gitobu Imanyara was besides himself declaring to the attendants publicly that "CJ Mutunga is one of our own" to which Odinga said agreed and essentially took credit for helping secure Mutunga the CJ's job. I kid you not. This wasn't the first time, soon after a multibillion shilling judgment was rendered against former president Moi, our CJ went into a closed door meeting with the former president and we haven't heard much of the case ever since. He has to be aware he in the public is watching and closely so. I just want to make sure the judiciary is in fact independent and there are no quid pro quo hanky panky monkeying around going on behind our backs and so far I don't like what I see.

No I want those of you who think that the judiciary should be left alone to do things as they please to know that is not the case. These are unelected officials of a co-equal branch of government and unlike the executive or the legislature who can be voted out every election cycle, these folks at the judiciary enjoy almost absolute tenure and have the least amount of oversight or scrutiny and that is the reason it has been the most rotten branch of government- that is why it is undergoing reform – because of the rot. So I want and expect these folks to be clean and we must put them through the wringer starting with the head honcho himself. I like CJ Mutunga a lot and I don't want him to fail. Not too long ago we had a well spoken and highly touted anti-corruption chief, PLO Lumumba, who let power get into his head so much so he lost bearing of the job at hand and went off the reservation somewhere, setting his own sting operations rather than prevent corruption, I don't want the CJ to get his eyes of the ball- NO. So far I am alarmed and he needs to correct course now.

What I want to hear CJ Mutunga actually talk about is what he plans to do about those cases and convictions determined by the judges and justices who have been purged from the judiciary. Methinks that those judgments are "fruits of poisoned trees" and I expect the CJ to recommend that those cases be heard de novo or be set overturned if indeed the judges who rendered those verdicts have been deemed incompetent- that is what I would like our CJ to champion and not politics and politicians.

In the past several months or so, Kenya's new Chief Justice Dr. Willy Mutunga has made combustible public statements on the subject of Leadership and Integrity with respect to Chapter Six of the new constitution and the upcoming general election. By his own admission, Justice Mutunga is an activist whose activism and human rights record propelled him to the judiciary. In most countries, activism, in and by itself, would disqualify him from being a judge let alone chief justice. Whereas many Kenyans may not be privy to the dangers that activism pose to the administration of justice, Mutunga's  pronouncements has left many befuddled and wondering what direction his leadership will take the judiciary.
