[wanabidii] William Ruto found guilty

Dear countrymen.

Does Hon.Ruto fall under the circumference of constitutional protection under Article 143 (1)!

The Depute President can perform the duties of the president when the situation call for.

The Muteshi land case commenced long before the Uhuruto made it to the Presidency.
Article 143(1.) of the constitution of Kenya Protects the President or any person performing the duties of the presidency during their tenure.

•(142) - Term of office of President
1.The President shall hold office for a term beginning on the date on which the President was sworn in, and ending when the person next elected President in accordance with Article 136 (2) (a) is sworn in.
2.A person shall not hold office as President for more than two terms.

•(143) - Protection from legal proceedings
1.Criminal proceedings shall not be instituted or continued in any court against the President or a person performing the functions of that office, during their tenure of office.

2.Civil proceedings shall not be instituted in any court against the President or the person performing the functions of that office during their tenure of office in respect of anything done or not done in the exercise of their powers under this Constitution.

3.Where provision is made in law limiting the time within which proceedings under clause (1) or (2) may be brought against a person, a period of time during which the person holds or performs the functions of the office of the President shall not be taken into account in calculating the period of time prescribed by that law.

4.The immunity of the President under this Article shall not extend to a crime for which the President may be prosecuted under any treaty to which Kenya is party and which prohibits such immunity.

The TJRC Report exempted Hon.Uhuru and Hon.Ruto from local processes since they are already facing ICC.Any referral will definitely see them going scot-free - for sure,we shall never know their innocence/guiltiness (so far they are innocent of the ICC CHARGES).
And now with the Mutesh case behind us unless Rutos lawyers appeal,our eyes should look at the negligence of commission for non prosecution of the P.E.V Perpetrators.Lack of political will is unlikely to see such prosecutions - in fact,attention is more on the accused,and almost silence on the P.E.V Victims!

The ICC is likely to take judicial notice of the Muteshi case since he is an I.D.P.

Hopefully,we shall not hear about So and so having influenced the ICC proceedings,ICC is against Africa.

WSR was yesterday, June 28th Friday,found guilty as charged by Kenyan high court.He was fined Kes.1M each year for last five years (5million) that he had illegally and forcefully acquired a land.The charge ranged from trespassing and illegal acquisition of private property from PEV victim.
Question now is, will he step a side! !
