Re: [wanabidii] Heri ya mwaka mpya 2013.

Hongereni kwa kupata fursa nyingine ya kuwapo wakati mwaka mpya unaopoanza. Jana na leo ni mabadiliko ya usiku na mchana kupokezana nyakati. Lakini kwa kuwa tunaamini kuwa jana tulikamilisha mzunguko wa siku 365 na leo ni mwanzo wa mzunguko mwingine, inatosha kutufanya tujiulize namna gani tumefaidika na mzunguko uliopita.

Karibuni katika mwaka 2013(ndio nimeandika huu mwaka kwa mara ya kwanza!).

Mwaka huu uwe wa Watanzania kuacha kulalamika na kuanza kutenda.
 
Watanzania tunalalamikia kila kitu, siku hizi eti mpaka watu wanalalamikia ujenzi wa barabara kwamba hazina maana kwa watu maskini wakati enzi zile tulipokuwa hatuna barabara kila mtu alilalamika kwamba nchi hii huwezi kusafiri wala kusafirisha kitu. Ni kulalamika tu, asubuhi, mchana, jioni hadi usiku. Zanzibar hata mtu akikimbiwa na mkewe analalamikia Muungano, huku Bara hata mtu akifumaniwa na kianafunzi analalamikia mafisadi. Ni kulalamika tuuuuuuuu!
 
Sasa tufanye kazi kwa juhudi na maarifa na tuwe wabunifu; wenzetu wanakimbia, sisi bado tunabishania hata kuruka kichurachura tu. Inabidi tufanye zaiid ya kukimbia; turuke kwenye nyungo sasa, na wasioweza wapande fisi kama farasi na wengine watumie mamba majini kama ngarawa.

Waheshimiwa,
Wiki iliyopita kabla ya Christmas, nilialikwa kuwa mgeni rasmi huko visiwa vya Komoro kwa kujadili masuala haya ya vyakula kutoka pande za ulaya ambavyo vimepigwa marufuku huku Ulaya kwaajili ya madhara mbali mbali.
Katika mijadala hiyo ambayo ilikuwa kwenye semina na workshops mbali mbali mbali za wiki 2 tulijaribu kutiliya mkazao vyakula vyetu vya Kiswahili ambavyo Wazee wetu walikuwa wakivitumiya kwa karne nyingi.
Katika semina hiyo, tulikuwa na wataalamu mbali mbali kama Professor Bakri Othman from U.S.A. ambawo wameonesha kitaalamu kuwa nchi nyingi za Kiaafrrika zinatumiwa kuwa jaa la vitu vilivyooza huku Ulaya.
Kwa hivyo sijastaajabu kuona mjadala huu, hapa kwenye mtandawo, na itabidi serikali zetu watiye mkazo kutumiya local products zetu zaidi katika mikahawa yetu,  madukani na nyumbani pia. Ni muhimu sana kuwasomesha watoto wetu kupenda vyakula vyetu vya jaddi ambavyo vina siha zaidi kuliko hivi vyakula vya ulaya.
Katika vitabu vingi vyangu vya mapishi ambavyo vinapatikana kwenye Amazon.com, nimeonesha ule ustaarabu tulikouwa nawo miaka mingi iliyopita, ya vyakula, na ustaarabu huu unapoteya.

Ndugu zangu, 

Imekuwa ni utamaduni wangu kutuma salamu za Mwaka Mpya kwa wanakijiji wa Mjengwablog, marafiki zangu kwenye FB na wengine walio ndani na nje ya mitandao ya kijamii.

 Nimefanya hivyo tangu mwaka 2006 ilipoanzishwa Mjengwablog. Na mwaka huu naendeleza utamaduni huo. Nina mambo makubwa mawili kwenye salamu za mwaka huu, lakini, nitaanza salamu hizi kwa kukumbushua ahadi muhimu ya Mwana –TANU; kwamba; 

 " Nitajielimisha kwa kadri ya uwezo wangu na kuitumia elimu yangu kwa manufaa ya wote". 

 Ndugu zangu, 

Siku kama ya leo miaka 30 iliyopita nilikuwa ndani ya garimoshi la Tazara nikielekea Dar kutokea kijijini kwetu Nyeregete. 

Nikiwa Nyeregete kwenye likizo ndefu ya kusubiri matokeo ya Kidato cha Nne, zilinifikia taarifa kuwa nahitajika haraka Dar es salaam kwenda kufanya maandalizi ya kuanza Kidato cha Kwanza shule ya Sekondari Tambaza. Masomo yetu pale Tambaza yalianza Januari 13, 1983. 

 Siku kama ya leo miaka 30 iliyopita nilivuka kwa kuogelea korongo la Lihamile ili kuifikia Rujewa na hatimaye stesheni ya Tazara kule Ihanga. Korongo hilo lilijaa maji ya mvua ya masika yaliyokuwa yakipita kwa kasi. 

Hakukuwa na daraja. Baadae likajengwa daraja la magogo wakati wa kipindi cha Ubunge wa Kanali Mstaafu, Edmund Mjengwa. Daraja hilo sasa limeoza. Halipitiki. Ahadi nyingi zimetolewa kulijenga upya. Zimebaki kuwa ahadi. Ni daraja muhimu kiuchumi na kijamii kwa watu wa Nyeregete na wengine wengi wenye kulitumia. Ni kero kubwa kwa wananchi wa Nyeregete. 

Nimeongea na baadhi ya viongozi wa Nyeregete. Na nimewaambia, kuwa tushirikiane kuhakikisha, kuwa mwaka 2013 daraja hizo linajengwa hata kama ni kwa nguvu za wananchi. Tayari tumeshafanya utafiti na kuona inawezekana likajengwa kwa kiwango cha zege na chini ya shilingi milioni 20. 

Hivyo basi, mwaka 2013 nitashirikiana na wananchi wa Nyeregete na wengine wote watakaokuwa tayari kusaidia kuhakikisha tunapitisha harambee ya kujenga daraja hilo. Miaka 30 baada ya mimi kuvuka Lihamile kwa kuogelea itakuwa ni aibu kubwa kuwaona tena wananchi wa Nyeregete na wengine wakivuka korongo hilo kwa kuogelea. Ni nini basi maana ya kwenda shule?

 Ndugu zangu, 

Maji ni kero kubwa kwa wananchi wengi wa Bonde la Usangu, Mbarali Mbeya. 

Badala tu ya kuilalamikia na kuisubiri Serikali iwasaidie wananchi kutatua kero ya maji, mwaka 2013 nimeazimia nitashirikiana na wanakijiji wa vijiji vya Magwalisi na Lihamile wilayani Mbarali ili tuweze kuchangisha fedha za kuchimba visima vya pampu kimoja katika kila kijiji husika. 

Nitashiriki kuchangisha sehemu ya fedha zinazohitajika kugharamia visima hivyo kwa kupanda Mlima Kilimanjaro, kitu ambacho nimependa nikifanye katika maisha yangu lakini sijapata bahati ya kufanya. 

Ndugu zangu, 

Hayo ni mawili makubwa niliyotaka kuyasema kupitia salamu za mwaka mpya wa 2013. 

Ni matumaini yangu, Desemba 31, 2013 Mungu atanijalia uhai na kurudi tena hapa kutoa tena salamu za mwaka mpya huku hayo mawili yakiwa tayari yameshafanyiwa kazi kwa nguvu za pamoja, ikiwamo ushirikiano wenu. Nawatakia Heri na Fanaka Za Mwaka Mpya wa 2013.

Failures of the Coalition Government in Kenya and Why Reform Accord is our Hope which will serve a show-case to the whole of Africa to rise above Corruption

Extreme corruption indulgences with deeper conflicts of interest are reasons why coalition Government failed from providing good leadership and this should not be taken lightly.

Kenya's Coalition Government needed to have changed their old ways of Status Quo to allow people opportunity to engage in sustainable progressive development if they expect to generate trust from public. Failing to provide the needed Reform change, they have no business to continue stay in power or seek public office any time soon.

We begun a journey of Reform that must be fulfilled, must come to fruitation and it must reach its destination. The destination is to see things change for better and peace, unity and love should be underlining factor to our progressive development agenda where we intend to improve our destiny with reliable sustained fixtures. If the vehicle we are travelling to reach our destination is faulty and has serious unrepairable mechanical problems, logistically, we got to leave it and look for a better means of travel. If there are people who agree with me on this prospect, then we are on the same page and we are not about to retain incorrigible politician failures or spoilers to continue to occupy public office; since they will contradict and scuttle our efforts for success. As it can be seen, they are the sore, pain and sufferings we have found ourselves in today.

The Constitution is a supreme authority that created the Institution of Parliament, the Executive, the IEBC which oversees electioneering, the CIC that ascertain Reform Constitutionality is in compliance according public mandate and the Judiciary which is the independent Jurisdiction Court of Law.

It is illegal for any person within the framework of the Constitutional institution to work against the Constitutional Policy for self political gains away from public mandate which one committed oath of office and swears to uphold. It is a known fact that Conflict of Interest contrasts, and constrains Public Mandate service delivery, thereby shortchanging security, reliability and effectiveness of good Governance with just rule of law function-ability to deliver the constitutional mandated public service. This could mean a demand for an automatic disqualification over non-compliance.

The Coalition Government may be in default if they are found to engage in delaying tactics with intent to overstay their time-line in office defrauding Reform Agenda. Such extension if proved, has consequences relative to integrity. The Constitution also demands that Kenya's elections take place after every five years. Political Parties are also required to be within the Constitutional Policy framework and guidelines. Finance Bill was one of the first proposals put on the table, it seemed like the politicians kept suspending it without any good reason; but it was clear the Coalition Government avoided engaging on Finance Bill because of serious controversial scandals surrounding utilization of public funds and expenditure of the same. Without Finance Bill, the Coalition is incomplete and the Coalition Government stand to have the Government Shut Down because it will have no funds to run the government. This would critically fail core value of constitutional legislation. The present scramble for Status Quo leadership engages failed technique of the Old corrupt Rule we now witness. We highly suspect these are conspiracies to evade Reform Accord policy for which the Coalition Government automatically becomes illegitimate after December 31st 2012.

Faced with the general falling situation including socio-economic challenges; matter of present Political, Social and economic vulnerability of the Coalition Government has put Kenyans, in crucial position which requires determination of the Reform Accord Agenda to take precedence to fill the void and conclusively curb fall-out and collapse by providing way forward.

If, in a total of 8 years Kibaki has not been able to bring change people want; in addition to 4 years PM Raila was accorded leadership in the Coalition Government and both were unable to provide good leadership but explosively plunder public wealth and resources with excessive lighting fire to fuel corruption, it is clear PM Raila's 4 years test in leadership capacity spells doom. This confirms PM does not have acumen or good agenda to Reform Kenya making the whole team in the coalition government vulnerable and are unable to fight corruption.

There is therefore state of urgency that need Reform way forward conclusiveness and Kenyan people must factor on realistic reform that balance theories and where plan for sustained Job creation with feasibility to agricultural food production being the concern.

The process Regulated through policy legislation commit elected officials to have no conflict of interest, but concentrate in Public Mandate of service delivery. It is here that people commit themselves to strict rules disciplined under the Law and Order to provide the needed balance in a fair share where all have the opportunity to use and utilize skills, talents innovation technology in a diversity away from monopoly control of the Special Business Interest Community…….

Government is bestowed to commit to deliver public mandate within a disciplined time frame; correct, establish, remedy and report anomalies of incidents of Corruption, Graft and Impunity that had eaten away and destroyed fabric of Good Democratic system with Just Rule of Law and to set in the right footings to engage New Order of Reform Accord Agenda. The Coalition Government Leadership did not strive to comply, instead, they opened flood-gates to explosive rampant corruption of unchecked exploitation from their office personnel to engage extension agents and networks to rip off public in twists and turns of conman-ship with organized gangs, thugs and mercenaries, stealing public corporation, facilities and utilities, and in an organized thieving, steal from the larger local village communities' cows as well as other cattle taking away their chickens and defraud farm produce to earn huge sums of money leaving the locals in gruesome poverty situation. The Prime Minister's Office personnel networking with political crooks with agents enjoined in shoddy deals plundering public utilities, facilities, wealth and resources, in the corruption galore, and in explosive sucker undercover maneuvers, plan and engineer unregulated "quick fix" for money deals, evading Tax Revenue but eating away public finances, wealth and resources illicitly and irregularly that without the prescribed legitimate Reform Agenda, Kenya will not and cannot recover from corruption, graft and impunity. This attitude will continue to fuel the already manufactured economic crisis and people will remain hostages in deeper pain and sufferings with extra-judicial killings from corrupt leadership, worse than we have already witnessed.

It is important to ensure farmers have access to farm tools, adequate affordable seeds and fertilizers. The cost of inputs sometimes is so high that farmers cannot afford the cost of carrying out the proper farming for optimum yields. It is here the Government should provide necessary services to boost peasant farmers in their yields and not exploiting them, pushing them to labor and enslaving them to produce from their meager energy and resources to deliver their farm produce to con-agents of unscrupulous government agent thieves' who in return sell the same at exorbitant price. Reasons for high food prices are because of bad leadership. Food prices have continued rising steadily because there are more people who have been forced out of their land by the middle con-businessmen/women who collect farm produce cheaply from the local village peasant farmers; in return sale the same at exorbitant price creating the imbalance of declining land with food insufficiency as a result, when the effect of dry weather compounds the situation, more people become vulnerable to the disastrous wide spread poverty situation. This is unacceptable.

This irregular way of job creation by the Coalition Government regime and it is unacceptable. The Staff and Agents of the Coalition Government invest and trade on monies that are dishonestly obtained from public account and they use the same to terrorize and oppress the poor people and bank other monies in foreign accounts. This trend cannot provide for sustained reform by any short or long margin. It is the reason there is no need to retain any of the incorrigible politically correct tainted brain to continue their stay in power. From what we have observed, the politically corrupt never wanted to change from their old unacceptable ways and are not ready to have their comfort zones interfered with or change their thievery corrupt style that has failed Kenya with the whole of Africa's larger community.

The conventional opportunity that factors for sustained Progressives Development theories for a justified Reform Accord Agenda people voted for at the Referendum to see a different approach from unchecked massive corruption of unscrupulous thievery the Coalition Government imposed in Kenya with inclusion of vision 2030 that is robbing public wealth and resources and which has become a death pill. Vision 2030 was not the primary Agenda as endorsed at the Reform Accord for Public Mandate. The Coalition Government leadership and their politically correct instead continued to pursue "The Unfinished Business" of past regime the reason why election turned deadly in 2007/8, which is why corruption became explosive and more catastrophically deadly during the Coalition Government tenure, forcing and driving people en mass to be forced to migrate away from their established communities and ultimately destroying peoples livelihood and survival……coupled with stealing the only food for and cattle they graze, this behavior drove many to early death from state of hopelessness to down trodden extreme poverty. Having proved that vision 2030 is part of the unfinished business of Moi for which Moi was compelled to "Fuata Nyayo" followed Kenyatta's footsteps, there is more than meets the eye……….with consequences that are truly catastrophic.

The unresolved injustices that were part in the demise of Patrice Lumumba of Congo, Tom Mboya's death, JM Kariuki's and Robert Ouko's…….the reasons why Haile Sellase of Ethiopia abandoned Ethiopia for the Special Business Interest and finally died in exile; are very much alive within politically correct collaborators and Leadership of the Coalition Government and are haunting to destroy our livelihood and survival if we do not stand tall and condemn it full scale; incorporate the Reform Responsibility with Integrity, if we must begin the newness of life after the Term of Office for the Coalition Government is ended.

We saw the larger International unscrupulous NGOs and Free Trading corporate investors of unscrupulous Special Business Interests in much the same light engaging in lucrative thieving targeting large tracks of land owned by local Community villagers who find themselves victims of circumstances and without justice they are forced to vacate and criminally were driven out of their lands under pressures from Government to vacate for the unscrupulous investors who through bribery and handouts are given to own the community lands illicitly and illegally. This is viewed with suspicion as a tide of explosive aggression of greed and selfishness.

People harboring grievances will no longer sit pretty. It is because of growing frustration turning into despair that will definitely lead to unfavorable dangerous violence uprising giving room to more serious situation that none of us would like to let things get out of hand.

To let the Coalition Government to expire, will help us gain our intended mission for Reform Accord (and that we complete our journey successful) at which our goals is to provide sustained and reliable job creation in terms of regaining what stalled in the lapsed of Reform Accord Agenda and improve and complete the process of Legislating the Constitution reviewing core value of Devolution Bill, Financial Bill, Police Bill and Land Bill to conform with Public Mandate thus providing a guiding principle to a functioning governance needed for Reform Accord Agenda.

Pondering Questions Requiring Urgent Investigation:

How the Prime Minister's Office workers suddenly became millionaires with extremely wealth. The Kamlesh Patni's, the John Maina's, the Caroli's, the Jakoyo Midiwo's with the group of "Clean-up" must declare their source of wealth and open for independent investigation to ascertain checks and balances, transparency and accountability that will provide settling contending challenges in a more civil way and where life is given the dignity it deserve and giving opportunity to improve our comprehensive approach for Reform.

Why Democracy Must be Made Functioning:

Good Governance can only work effectively with an establishment of a good and stable functioning Democracy put in place. Much need to be done in Africa to alleviate poverty and improve food sufficiency and make extra for small business for self-sufficiency. Law and order must be restored for the interest and security for all.

Our goal therefore is to establish a quality assurance institutional mechanism to help grassroots peasant small farmers with small household business for self-reliance to take effect in sub-Saharan Africa will cost $7 million in five years. This will help to enhance development agenda through Africa Diaspora Network Exchange for Success.

It is crucial for a country's leadership to be in touch with the mood of its citizens; but with mushrooming of organized crimes who are connected to law enforcement authorities, as in a number of African countries, citizens are constantly living under threats and they feel mostly insecure. Thugs and criminals ride and mingle with ordinary citizens in public transportation where many find themselves as victims of frequent attacks, ambush and sometimes hijacked transportation by the terrorist thugs……..people living in fear 24/7 in Kenya for example.

Our Plan of Action is to realize the bility of citizens to meet their daily needs for food and shelter, the struggle is effortless, and this kind of situation is breeding more complicated and sophisticated organized criminals from the jobless educated society because life must go on.

AFRICA'S BIG LOSES IN FOREIGN EXCHANGE & HOW TO CURB IT.

Most countries in Africa are characterized with low domestic savings and do not have access to international capital markets. In addition, official loans and foreign assistance per capita to the region have decreased because of extreme political corruption involving African Leaders.

These important concern are factored in failed Millennium Development Goals that pushed Africa to extreme poverty in the roles of macroeconomic uncertainty where people's income is less than $1 a day and majority suffer from hunger from failed Government Planning. Too much corruption in Africa is the reason for Africa's failed economy. The Corrupt African Leaders working with Unscrupulous International Special Interest Business have capital flow unrecorded as a result of secret business deals done under-table. This is why Transparency and Accountability in Democratic Governance is crucial and urgent; in order to examines the roles of macroeconomic uncertainty, political risk, as well as host country institutions, where FDI (Foreign Direct Investment) is affecting currency inflows into African economies from Foreign Direct Investment; and without which, the middlemen traders affect the chain of money flow to the grassroots.

Foreign direct investment (FDI) has become a key element of the global economy. Supply Vs. Demand must balance. There is therefore need to adopt and maintain the Local Policy that balances with the International Regulation on Trading Policies that are favorably to allow Africa's Economy with the rest of the world to flourish.

FDI has great potential to generate employment, raise productivity, transfer skills and technology, enhance exports and contribute to both the long-term economic development of Africa with those of the world's developing countries e.g. the (UNESCO, UNCTAD). These are the reasons why COMESA (Common Markets of Eastern and Southern Africa) where, "The micro, small and medium enterprises (MSMEs) have significant potential to spur overall economic development and take a leading role in poverty eradication, jobs and wealth creation as well as improving the quality of life of the African people," …….in a risk free conducive peaceful environment for business to thrive between the private sector the cooperating partners, the United Nations International Finance Banks with other Investing Individual Business Partners or Foundations. The miss-Trust & broken down proper government system with dysfunctional of government's corrupt personnel made the plan to fail thus resulting to COMESA's procurement information system needed to facilitate service delivery non-effective.

Although, no government, no global nonprofit, no multinational enterprise can seriously claim to be able to replace the 1.8 billion jobs created by the economic underground, International Trade Policy Regulations in Government Democracy of the world is a must for the sake of Peace and Harmony with environmental protection. In truth, the best hope for growth in most emerging economies lies in the shadows of secure and stable Government Democracies of the world.

Worldwide, the underground economy is estimated to have provided 1.8 billion jobs.

There is no single underground economy; there are many. These underground economies are omnipresent, existing in market oriented as well as in centrally planned nations, be they developed or developing. Those engaged in underground activities circumvent, escape or are excluded from the institutional system of rules, rights, regulations and enforcement penalties that govern formal agents engaged in production and exchange. Different types of underground activities are distinguished according to the particular institutional rules that they violate. Five specific underground economies can be identified:

3.the unreported economy

4.the unrecorded economy

5.the informal economy

The "illegal economy" consists of the income produced by those economic activities pursued in violation of legal statutes defining the scope of legitimate forms of commerce. Illegal economy participants engage in the production and distribution of prohibited goods and services, such as drug trafficking, arms trafficking, and prostitution.

The "unreported economy" consists of those economic activities that circumvent or evade the institutionally established fiscal rules as codified in the tax code. A summary measure of the unreported economy is the amount of income that should be reported to the tax authority but is not so reported. A complementary measure of the unreported economy is the "tax gap", namely the difference between the amount of tax revenues due the fiscal authority and the amount of tax revenue actually collected. In the U.S. unreported income is estimated to be $2 trillion resulting in a "tax gap" of approximately $450–$500 billion in loses to the Government.

The "unrecorded economy" consists of those economic activities that circumvent the institutional rules that define the reporting requirements of government statistical agencies. A summary measure of the unrecorded economy is the amount of unrecorded income, namely the amount of income that should (under existing rules and conventions) be recorded in national accounting systems (e.g. National Income and Product Accounts) but is not. Unrecorded income is a particular problem in transition countries that switched from a socialist accounting system to UN standard national accounting. New methods have been proposed for estimating the size of the unrecorded (non-observed) economy, but there is still little consensus concerning the size of the unreported economies of transition countries.

The "informal economy" comprises those economic activities that circumvent the costs and are excluded from the benefits and rights incorporated in the laws and administrative rules covering property relationships, commercial licensing, labor contracts, torts, financial credit and social security systems. A summary measure of the informal economy is the income generated by economic agents that operate informally. The informal sector is defined as the part of an economy that is not taxed, monitored by any form of government, or included in any gross national product (GNP), unlike the formal economy. In developed countries the informal sector is characterized by unreported employment. This is hidden from the state for tax, social security or labour law purposes but is legal in all other aspects. On the other hand, the term black market can be used in reference to a specific part of the economy in which contraband is traded.

Pricing

Goods acquired illegally take one of two price levels:

They may be cheaper than legal market prices. The supplier does not have to pay for production costs or taxes. This is usually the case in the underground economy. Criminals steal goods and sell them below the legal market price, but there is no receipt, guarantee, and so forth.

They may be more expensive than legal market prices. The product is difficult to acquire or produce, dangerous to handle or not easily available legally, if at all. If goods are illegal, such as some drugs, their prices can be vastly inflated over the costs of production.

Black markets can form part of border trade near the borders of neighboring jurisdictions with little or no border control if there are substantially different tax rates, or where goods are legal on one side of the border but not on the other. Products that are commonly smuggled like this include alcohol and tobacco. However, not all border trade is illegal.

Looking Back to African Government History for Show-Casing

In DR Congo it is estimated that gold and diamond deposits alone could fetch the country 23 trillion dollars not to mention the abundance of timber and other several minerals that are found in large quantities such as columbo-tantalite (coltan) and cassiterite (tin ore) yet years of corruption, mismanagement, conflicts and foreign involvement have made this resource rich nation one of the poorest in the world. Western nations cannot maintain their current level of lifestyle without Congo. Most corporations in the west can easily go bust without Congo. If Congo is the bloodline of the west and the west is rich because of Congo, why is Congo so poor?

Where are the billions of dollars from the sale of these minerals? The answer lies in the history of the nation which is endemic corruption, armed conflict with foreign involvement who failed and fueled World Economic crisis and collapse as a result of wrong way of creating jobs……jobs that fill the void of the selfish and greedy businessmen and women, jobs that cannot provide a balance to offer opportunity for sustained progressive development agenda. Mobutu in his 32 year reign is believed to have taken several billions of dollars from the treasury and deposited it in his numerous Swiss bank accounts.

Africa is poor today because Swiss and other western banks collude with African kleptocrats to loot the continent. Corruption is rife on the continent because those who steal the money never lack a place to hide it. The dictators are able to steal so much because Western governments particularly France, Britain, Switzerland and the United States often turn a blind eye to the adulterous relationship between their governments, MNCs and the dictators in Africa. On 21 June 2010 Christine Lagarde, French Finance Minister and Ngozi Okonjo-Iweala of World Bank wrote an article titled "No Safe Havens for Dirty Money". In their article they urged all countries to play by the rules, fight corruption and end safe haven practices. They argued for "better regulation, good governance, and accountability. "No safe havens for tax evasion. No safe havens for money laundering and terrorism financing, and no safe havens for cozy financial regulation" so they wrote but Ms Lagarde and her government have done little if not nothing to practice what they preach. Ben Ali of Tunisia, the Bongos in Gabon, Paul Biya of Cameroon, Nguesso and Dos Santos have become very corrupt because of their closeness with successive French governments, politicians and the business elite in France.

Fighting corruption should not be left to the poor countries alone. Western countries have a duty to stop their nations being used as safe havens for stolen monies from the African continent. They should return all looted money put there by corrupt African leaders to the African people. There must be an international coalition dedicated to tracking all stolen monies on the face of the earth with Africa given to priority.

History of corruption in Africa is the reason for excessive poverty, instability and violence in oil producing countries (like Nigeria, Equatorial Guinea, Gabon, Congo and Cameroon). In East Africa and the rest of Sub-Sahara upcoming oil business if not put in the right perspective with proper Governing establishment; where complete regulatory transparency with zero tolerance in corruption is not observed in oil, water, Gold, Diamond, Colton with other natural mineral including the agricultural produce; if these sectors are not put under Reform Accord plan, they will not yield good return to boost progressive development agenda we strive for.

The recently released US Diplomatic Cables by Wikilieaks indicate that the country's leaders are engaging in massive corruption and back door dealings that are slowly adding to the dire corruption situation in the country. One case involves Security Minister and National Resistance Movement (NRM) Secretary General Amama Mbabazi and Energy and Mineral Development Minister Hilary Onek who the report says have "benefited from the sale of production rights by Heritage Oil and Gas to Italian oil giant ENI". Security Minister Mbabazi and Energy Minister Onek "received payments from Heritage and/or ENI in exchange for their support". According to the diplomatic cable the Italian multinational firm "ENI created a shell company in London called TKL Holdings – through Mark Christian and Moses Seruje (who acted as frontmen) to funnel money to Mbabazi.

In Sudan the recently released US diplomatic cables by Wikileaks show that Omar Al Bashir has been able to loot 9 billion dollars of the country's oil proceeds and stashed it in UK and other jurisdictions with the help of British banks especially the Lloyds Banking Group. According to the US cable leaked by Wikileaks Luis Moreno-Ocampo, the International Criminal Court prosecutor contemplated going public with Bashir's loots which has turned Sudan into a desert of poverty. "Ocampo reported Lloyds bank in London may be holding or knowledgeable of the whereabouts of his money".

In countries such as Egypt, Cameroon, The Gambia and Libya, a kleptocracy class of people have replaced anything democracy. Leaders amass wealth at the expense of their poor countries and continue to mismanage whatever remains of their corrupt activities. Because most of the leaders are former military officers or former rebels with no grasp of economics and management, they are unable to formulate any good economic policies that will transform and grow their economies hence poverty has become a part of the people but their leaders know not what poverty is.

Corruption is an endemic cancer that has devastated African societies and impoverished millions. According to the Africa Union (AU) around $148 billion are stolen from the continent by its leaders and civil servants every year. The 2006 Forbes' list of most corrupt nations had 9 out of the first 16 countries coming from Africa. According to Global Financial Integrity (GFI) a US based anti-corruption group, the continent of Africa has lost more than 854 billion dollars in illicit financial outflows between 1970 and 2008. GFI director Raymond Baker says the amount of money that has been drained out of Africa—hundreds of billions decade after decade—is far in excess of the official development assistance going into African countries.

The illicit flow of such huge amount of money is not the work of African leaders and their associates alone but also that of multinational corporations from Europe, America and Asia doing business in Africa. For example the multinational corporations understate their profits and falsify profit documents. They also undervalue their goods, indulge in smuggling, theft and the falsification of invoicing and non-payment of taxes, as well as and employing kickbacks and bribes to public officials. They also overprice projects; provide safe havens for looted funds, all of which affect the financial capability of countries in Africa to fight poverty. In 2002, Halliburton, a US company, was accused of establishing $180m flush fund with the intent of using it to bribe Nigeria officials in order to secure a $6billion Liquefied Gas Plant contract in Nigeria. The company fired Mr. Albert Jack Stanley, its executive. A report by the company later named a British called Jeffrey Tesler as the middleman behind the bribery. In 2010 Nigerian authorities brought charges against former US Vice President Dick Cheney and Halliburton for their role in the bribery scandal. The charges were settled out of court after the defendants agreed to pay 35 million dollars. On 17th September 2002 for example, a Canadian Engineering company called Acres International was convicted by a High Court in Lesotho for paying $260,000 bribe to secure an $8 billion dam contract in Lesotho. Achair Partners, a Swiss company and Progresso, an Italian company have been accused of bribing Somali Transition Government officials in order to secure contracts to deposit highly toxic industrial waste in the waters of Somalia.

But the corporations and foreign politicians and business executives are not the only ones in the game. The governments in Africa have been doing their best to loot their countries' coffers with impunity. The recently released US diplomatic cables by Wikileaks indicate how corruption has become part and parcel of President Ben Ali's family and government in Tunisia. And the worse thing is that it is getting worse by the day. Part of the cable states that: "According to Transparency International's annual survey and Embassy contacts' observations, corruption in Tunisia is getting worse. Whether it is cash, services, land, property, or yes, even your yacht, President Ben Ali's family is rumoured to covet it and reportedly gets what it wants. President Ben Ali's extended family is often cited as the nexus of Tunisian corruption. Often referred to as a quasi-mafia, an oblique mention of "the Family" is enough to indicate which family you mean. Seemingly half of the Tunisian business community can claim a Ben Ali connection through marriage, and many of these relations are reported to have made the most of their lineage. Ben Ali's wife, Leila Ben Ali, and her extended family — the Trabelsis — provoke the greatest ire from Tunisians."

The Cables point out that the corruption at the presidency has trickled down to all aspect of Tunisian society. "Beyond the stories of the First Family's shady dealings, Tunisians report encountering low-level corruption as well in interactions with the police, customs, and a variety of government ministries. When a contact was asked about whether he thought corruption was better, worse, or the same, he exclaimed in exasperation "Of course it's getting worse!" He stated that corruption could not but increase as the culprits (Ben Ali and his cohorts) looked for more and more opportunities. Joking about Tunisia's rising inflation, he said that even the cost of bribes was up. "A traffic stop used to cost you 20 dinars and now it's up to 40 or 50!" The economic impact is clear, with Tunisian investors — fearing the long-arm of "the Family" — forgoing new investments [abroad and] keeping domestic investment rates low." Tunisians openly talk about how corruption is destroying their country and bemoan the lack of effort by the authorities to tackle it. "Corruption is the elephant in the room; it is the problem everyone knows about, but no one can publicly acknowledge. The lack of transparency and accountability that characterize Tunisia's political system similarly plague the economy, damaging the investment climate and fueling the culture of corruption" says the Cable.

Despite years of exports of oil, gold, diamond, bauxite, tin, coltan, uranium, manganese timber and other minerals, the continent of Africa is ranked the poorest, this is not right. Revenue from the minerals finds its way into the bank accounts of corrupt government officials, politically correct agents and the civil servants with their Allie collaborators, and this must be put to a dead stop.

Things must change for better people if we care for unity under peaceful and loving environment.........and if in caring we must share fairly and leave this world better than we found it..........!!!

Witnesses' safety ICC prosecutor's biggest worry as trials loom

Security concerns against key witnesses in the two Kenyan cases at the International Criminal Court (ICC) remains the biggest hurdle for the prosecution as the deadlines set by the Trial Chamber looms.
ICC Prosecutor Fatou Bensouda is agonising over the security of witnesses she has lined up including Mungiki insiders following tight disclosure deadlines set by the three-judge Bench.
In their decision on the schedule leading up to trial, the judges set a calendar of events that both the prosecution and the defence must abide by ahead of the trials that kick off on April 10 and 11.
Deputy Prime Uhuru Kenyatta and Eldoret North MP William Ruto are facing crimes against humanity charges at The Hague-based court.
The two are also in the race to State House in the vote scheduled for March 4, next year.
Their co-accused are former Head of Civil Service Francis Muthaura and Radio journalist Joshua arap Sang.
According to the schedule, the prosecution is supposed to file list of witnesses and list of evidence to be relied on at trial by January 9.
Incriminatory material
The bench led by Presiding Judge Kuniko Ozaki also set the same date for the disclosure of all incriminatory material in the form of witness statements and any other material to be relied on at trial.
Also to be filed on the same day is a pre-trial brief, a document explaining with case reference the evidence the prosecution intends to rely on at trial and must contain for each count a summary of the relevant evidence of each witness.
But already Bensouda is seeking authorisation from the bench to delay disclosure of identities of 15 key witnesses beyond the January 9, citing security concerns.
Out of the 15, six are expected to testify in the case against Uhuru and Muthaura while the rest apply to the case against Ruto and Sang.
Bensouda, who made an extensive tour of the country last month, had raised the red flag that some key witnesses have been intimidated, compromised, or threatened with death.
She wants to be allowed to conceal the identities of the witnesses until 30 days before the trial date or 30 days before the date they are expected to testify.
The witnesses against Uhuru and Muthaura whose identities Bensouda want concealed are former members of the outlawed Mungiki sect, whom the prosecution believe have insiders accounts of how pro-ODM supporters where brutally murdered in the Rift Valley.
However, Bensouda says several top officials of the outlawed sect were murdered after the post-election violence, a big security concern should their identities be disclosed.
She revealed the witnesses believe the killings and forced disappearances was part of a post-election violence "clean-up" conducted by State agents to conceal the involvement of the accused and other senior officials.
'Insiders' evidence
"Several senior Mungiki members disappeared or were murdered by suspected members of the Kenyan security apparatus in the immediate aftermath of the PEV. These individuals had direct knowledge of the accused contributions to the crimes charged," Bensouda said in her application.
She maintained that the nature of the 'insiders' evidence creates a powerful incentive to the suspects to interfere with them so that they do not testify.
The ICC Chief Prosecutor said one of the witnesses provides critical evidence regarding the strategic meetings in which the Rift Valley attacks were organised.
She pleaded with the judges to grant her request, saying that there is limited pool of Mungiki members who are still alive and willing to testify.
"The insiders' evidence is irreplaceable. Were they to be tampered with, it would substantially affect the prosecution's case. This creates a powerful incentive to interfere with the insiders," argued the prosecutor.
Bensouda believes that since the accused are not in custody, their contacts with supporters or potential witnesses cannot be limited and monitored.
She argues that The Hague-based court has no capacity to control, or even to monitor, the conduct of persons in a non-custodial situation thousands of miles from the seat of the court.
"In addition, these particular accused have influential positions within and/or close ties to the Government of Kenya, which compound both the risks they pose and the difficulties in mitigating them," Bensouda noted.
She also argues that the nine witnesses in the Ruto-Sang case have specific security concerns on their safety, physical and psychological wellbeing, dignity and privacy.
The defence teams in the two Kenyan cases have previously challenged the credibility of the ICC witnesses, insisting that their identities be disclosed.
Uhuru, for instance, branded some three witnesses as liars, claiming they initially attempted to extort money from him and only turned to the prosecution when he refused to bribe them.
The DPM added that he is ready to table evidence, including visual, audio and written word to prove to the court that his claim is factual.
January 9 deadline
Already, Ruto and Sang have made an application to the judges seeking to compel the prosecution to disclose whether the five witnesses whose testimony led to the confirmation of charges against them would testify during their trial.
They are apprehensive the prosecution is reluctant to make the disclosure prior to the January 9 deadline in order to swamp them with new evidence, something which they feels is a tactic that will disadvantage them at the most critical stage.

Why Corruption Must be Put to a Stop in Kenya and Africa in General if Africa must compete in the Global Emerging Markets?

Corruption can refer to many different types of illegal acts, though they will usually all involve a person abusing their authority for their own benefit, or for the benefit of family and (political) friends. This can be government officials using public money for their own personal use, or corporate executives improperly awarding contracts or taking other decisions in exchange for bribes.

Incidents of corruption in Kenya are not limited to large corporations or government agencies. Bribe-taking is common among many lower-level officials, with the average city-dwelling Kenyan having to pay as many as 16 bribes each month just in the course of everyday life.

Corruption by Kenya's Presidents

Unfortunately, corruption played a role with all 3 Kenyan presidents up to now.

Jomo Kenyatta

He was the first president of Kenya after independence in 1963. During colonialism, the European colonizers had stolen fertile lands from, among others, the Kalenjin tribe. After the independence (in 1963), Kenyatta did not return those lands to the former owners, but handed it over to members of his own clan and tribe (the Kikuyu). Kenyatta himself became one of the largest private land owners in the country.

Daniel arap Moi

During Daniel arap Moi's presidency – Kenya's second president – corruption was widespread and involved Moi himself on many occasions. In the 1990s, he was part of the Goldenberg scandal, where smuggled gold was exported out of Kenya in exchange for high government subsidies. It's one of the largest corruption scandals to date in Kenya, which involved nearly the entire Moi government. Many officials from the Central Bank, and more than 20 senior judges have also been implicated. As of 2008, only a small handful of people been charged with a criminal offense, which some see as an example of the continuing problem of corruption and favoritism.

Mwai Kibaki

The third president, Mwai Kibaki, was elected in 2002 mainly on the promise to end corruption in Kenya once and for all. Admittedly, there have been quite some improvements in the country (among them press freedom, return of elections and introduction of free and compulsory primary education for all) but corruption had remained a big issue. To start with, his administration consists largely of Kikuyu, while this tribe is only 22 percent of the Kenyan population. From 2003 to 2006, Kibaki's cabinet spent 14 million dollars on new Mercedes cars for themselves. In late 2008, several members of Kibaki's parliament were found to have taken large "allowances", which were not legally part of their official compensation. And Kibaki has probably falsified the results of the 2007 election, leading to riots.

The Kenya Anti-Corruption Commission

Though legislation against corruption in Kenya has existed since 1956, with the Prevention of Corruption Act, the current anti-corruption agency has only been operating since 2003.

Under the Anti-Corruption and Economic Crimes act, the KACC is mandated to fight and prevent corruption though all levels of government and industry. They publish a number of regular reports and newsletters, with the aim of promoting fair business practices and to expose those who engage in questionable operations.

Causes Of Poverty In Kenya

Despite some positive developments, poverty in Kenya has continued to be a huge problem. Even hunger in Kenya continues to rear it's head from time to time. This page looks at the facts, the causes and the remedies.

Extent of Poverty in Kenya

The dry poverty statistics in Kenya sum it all up. Somewhere between one quarter and half of the population earn less than $1 US each day (the annual GDP per capita is around $360 US). It was estimated in 1992 that half of all rural Kenyans were living below the poverty line. That represents approximately 9 million people. The situation is not quite as bad in the urban centers, where such poverty only effects a third of the population.

Kenya's World Ranking Regarding Poverty

A 2005 report by the United Nations ranked Kenya as 154th out of a list of 177 countries, in terms of life expectancy, literacy levels and overall gross domestic product. Just three years earlier, the country had ranked 134th. For comparison, Uganda was ranked at 144th, and Tanzania was 164th. Both are immediate neighbors of Kenya.

There are several factors contributing to the ongoing problem of poverty in Kenya, though the issue of Kenya's economic state is far more complex than a simple list of causes.

Limited Economic Diversity Kenya Government in the past took huge loans to improve but ended doing nothing……..Where did the loans taken from World Banks, IMF, UN Financial Institutions, African Union Banks etc.,

Around three quarters of Kenya's population is dependent on the agriculture industry, but with its erratic weather patterns and vast regions of arid desert, it is a very unstable sector. Periods of drought can be crippling, not only in terms of food supply, but in jobs as well.

Even when crops have been sufficient, poor government policies and international trade terms hampered agricultural growth, leading to further declines in the industry through the 70s and 80s. Starting in 1991, further serious problems in the country's GDP became evident, leading to extended government action which has not proven to be successful at stemming the tide of poverty in Kenya.

Why record Lack of Opportunity when Funds were made available?

Weak overall infrastructure for the country means that nearly all the rural population are forced to rely on their own subsistence farming for their own food as well as monetary income. Jobs are scarce, leaving people with little opportunity for employment. There are considerable obstacles for starting a small business yourself in Kenya as well. Micro credits may be one way to foster small entrepreneurs. They will be important when eradicating poverty in Kenya.

Another factor is education. School fees are often out of reach for poor families, leaving each generation to continue trying to find work while lacking the education to advance. Cultural biases towards women create further limitations for the growing number of female-led households.

Why Government Corruption escalated

According to Transparency International, Kenya is one of the most corrupt nations in the world. It is difficult for the majority of the population to escape the poverty in Kenya, when government money is used improperly.

Bribes, fraud and tribal favoritism are common within the all levels of government, which hampers any attempt to improve conditions across the country. In the early 2000s, the Kenyan government began taking steps to reduce the rampant corruption. These reforms have inspired some confidence, and brought additional foreign investment back to Kenya, but at the core of the system corruption remains.

Corruption

The longest-running is the Goldenberg scandal [2], where the Kenyan government subsidized exports of gold, paying exporters in Kenyan Shillings (Sh) 35% over their foreign currency earnings. In this case, the gold was smuggled from Congo. The Goldenberg scandal cost Kenya the equivalent of more than 10% of the country's annual GDP.

In 1998, political scientist Mutahi Ngunyi's NGO - Series for Alternative Research in East Africa (SAREAT) engaged John Githongo to edit a regional political economy magazine, East African Alternatives[3]. The magazine folded after an audit instigated by the lead donor Ford Foundation found suspected misappropriation and collusion on the part of Ngunyi, who was executive director of SAREAT and Dr Jonathan Moyo, who was the programme officer at the Ford Foundation in charge of disbursing the resources to the NGO. They have both been sued and the matter is still in court. It is known that the Ford Foundation has accepted Githongo's offer to be a prosecution witness in the case.

A Sh360 million helicopter servicing contract in South Africa[4]. Military officers had argued that the contract was too extravagant and servicing the helicopters could be done locally. Kenya Air Force (KAF) went ahead to spend Sh108 million as a down payment for servicing the Puma helicopters, whose tail number is logged as 418 at Denel Aviation, a South African firm.

In 2003, the military was split over plans to buy new Czech fighter jets[4]. The plan to buy the jet fighters would have cost taxpayers Sh12.3 billion.

A Sh4.1 billion Navy ship deal [4]. A Navy project was given to Euromarine, a company associated with Anura Pereira, the tender awarded in a process that has been criticised as irregular. The tender was worth Sh4.1 billion. Military analysts say a similar vessel could have been built for Sh1.8 billion.

Chamanlal Kamani had been involved in a supply contract, as Kamsons Motors. [5] Kampsons tendered for the supply of Mahindra Jeeps to the Police Department in the mid 1990s for close to Sh1 million (US$13,000) each, at a time when showrooms would have charged customers a sixth of the price. Moreover, the vehicles were being bought for a government department and were therefore imported duty free. Few of the more than 1,000 units that were imported over several years are in service today.

The Kamanis were also involved in a deal to build a CID forensic laboratory. On June 7, 2004 an amount of $4.7 million was wired back. The payment was a refund against the money paid for the Criminal Investigations Department forensic laboratory. [6]. Another euro 5.2 million was paid back in respect of the E-cop project, which involved computerisation of the police force and the installation of spy cameras in Nairobi by Infotalent Systems Private Limited.

The Prisons department lost $3 million after contracting Hallmark International, a company associated with Deepak Kamani of Kamsons Motors, for the supply of 30 boilers. Only half of the boilers were delivered – from India and not the United States as had been agreed.

The construction of Nexus, a secret military communication centre in Karen, Nairobi. The Government spent Sh2.6 billion (US$36.9 million) to construct the complex. Three years later, military personnel have not moved into the centre. A phantom company, Nedermar BV Technologies, which is said to have its headquarters in Holland, implemented the secret project situated along Karen South Road. Nedermar is linked to businessman Anura Pereira. However, Pereira has denied this. The tendering process for the Nexus project was circumvented as DoD's Departmental Tender Committee. Funding for the project was made through the Ministry of Transport and Communications. The complex is currently headed by Colonel Philip Kameru. Nexus was first meant to be an ammunition dumpsite before it was turned into a military communication and operations centre. Construction continued without any site visits by either the DoD staff or Ministry of Public Works officials. The Nexus project was implemented during the tenure of General Joseph Kibwana.

In 2005 plans to buy a sophisticated £20 million passport equipment system from France. Here government wanted to replace its passport printing system. The transaction was originally quoted at 6 million euros from François Charles Oberthur of Paris - the world's leading supplier of Visa and MasterCards, but was awarded to a British firm, the Anglo-Leasing and Finance Company Limited, at 30 million euros, who would have sub-contracted the same French firm to do the work. Despite the lack of competitive tendering Anglo Leasing was paid a "commitment fee" of more than £600,000. Anglo Leasing's agent is a Liverpool-based firm, Saagar Associates, owned by a woman whose family has enjoyed close links with senior officials in the Moi regime. Company records show Saagar Associates is owned by Mrs Sudha Ruparell, a 47-year-old Kenyan woman. Ruparell is the daughter of Chamanlal Kamani, the multimillionaire patriarch of a business family that enjoyed close links with senior officials in the Moi regime. Anglo Leasing made a repayment of euro 956,700 through a telegraphic transfer from Schroeder & Co Bank AG, Switzerland on May 17, 2004.

The local chapter of Transparency International and the Kenya National Commission on Human Rights (KNCHR), a government body released a report in February, 2006, stating that between January 2003 and September 2004, the National Rainbow Coalition government spent about $12-million on cars that were mostly for the personal use of senior government officials. The vehicles included 57 Mercedes-Benz, as well as Land Cruisers, Mitsubishi Pajeros, Range Rovers, Nissan Terranos and Nissan Patrols. The $12-million substantially exceeded what the government spent over the 2003/04 financial year on controlling malaria -- "the leading cause of morbidity and mortality in Kenya", says the report.

In late February 2006, the leading newspaper The Standard ran a story claiming that president Mwai Kibaki and senior opposition figure Kalonzo Musyoka had been holding secret meetings. On March 2 at 1:00am local time (2200 UTC on the 1st), masked gunmen carrying AK-47s raided multiple editorial offices of The Standard, and of its television station KTN. They kicked and beat staff members, forcibly took computers and transmission equipment, burned all the copies of the March 2nd edition of the newspaper, and damaged the presses. At KTN, they shut down the power, putting the station off the air. Initially, the Kenyan information minister claimed no knowledge of the raid, but it has since revealed that Kenyan police were responsible. The Ministry of the Internal Security later stated that the incident was to safeguard state security. "If you rattle a snake you must be prepared to be bitten by it," John Michuki said. Three journalists at The Standard, arrested after the critical story was printed, are still being held without charge. The story now also features the bizarre case of two Armenian businessmen, mocked in the press for their taste for heavy gold chains, watches and rings, referred to as Mercenaries, who the opposition says led the raid and had shady dealings with Kibaki's government.

In November 2006, the government was accused of failing to act on a banking fraud scam worth $1.5bn involving money laundering and tax evasion, reported by whistle-blowers as early as 2004. Investigators believe sums worth 10% of Kenya's national income are involved. A recent auditor's report says the scale of the operations "threatens the stability of the Kenyan economy".

In November 2006, British Foreign Office minister Kim Howells warned, that corruption in Kenya is increasing the UK's exposure to drug trafficking and terrorism. "People can be bought, right from the person who works at the docks in Mombasa up to the government. (...) This weakness has been recognised by drug-traffickers and probably by terrorists too." Said Howells for the BBC.

On 31 August 2007, The Guardian newspaper featured on its front page a story about more than GBP 1 billion transferred out of Kenya by the family and associates of former Kenyan leader Daniel arap Moi. The Guardian sourced the information from the Wikileaks article The looting of Kenya under President Moi and its analysis of a leaked investigative document ("the Kroll report") prepared for the Kibaki government in 2004 in order to try to recover money stolen during Moi's rule.

On 2007-09-06 parliament passed the Statute Law (Miscellaneous Amendments) Bill, restricting investigations by the Kenya Anti-Corruption Commission to offenses committed prior to May 2003, excluding the Goldenberg and Anglo-Leasing scandals and other major cases. The move was condemned by anti-corruption campaigners; Mwalimu Mati, former chief executive of the Transparency International Kenya Chapter, declared that "grand corruption has swallowed the government and parliament that Kenyans elected to fight it in 2002". In response to public outrage generated by the move, President Kibaki announced that he would veto the bill.

In September 2007, Wikileaks released documents exposing a 500 million Kenyan shilling payroll fraud at Egerton University] and subsequent cover up, now the subject of ongoing legal dispute in the High Court.[citation needed]

On the 28th of September 2007, Wikileaks released 28 investigative documents] exposing a US$1.5 billion dollar money laundering fraud by Charter House Bank Ltd. Re-reported in the Kenyan Standard newspaper.[citation needed]

In June 2008, the Grand Regency Scandal broke, wherein the Central Bank of Kenya is alleged to have secretly sold a luxury hotel in Nairobi to an unidentified group of Libyan investors for more than 4 billion Kenyan Shillings (approx US $60 million) below the appraised market value. Finance Minister Amos Kimunya negotiated the sale, and was censured in a near-unanimous motion by the Kenyan Parliament, though he vehemently denies the charges. This follows on the heels of the Safaricom IPO, overseen by Kimunya, which has been alternatively praised and questioned for possible corruption in the execution of the sale. Safaricom is the largest mobile phone service provider in Kenya, having operated with a near-government monopoly for many years. The government of Kenya sold its 50% stake in Safaricom in the IPO.

Deal with UDF returns to haunt Uhuru, Ruto

NAIROBI, KENYA: Deputy Prime Minister Musalia Mudavadi's exit from the Jubilee Alliance is far from settled.
Acting Registrar of Political Parties Lucy Ndung'u is scheduled to meet officials of The National Alliance (TNA), United Republican Party (URP), and United Democratic Forum (UDF) on Monday over the matter.
But it is unclear if the meeting called by Ms Ndung'u will kick off after an MP close to Ruto dismissed it as a "sideshow".
The Standard established that a clause in the addendum that Deputy Prime Minister Uhuru Kenyatta's TNA, Eldoret North MP William Ruto's URP and Musalia Mudavadi's side lodged with the Registrar of Political Parties has implications on their presidential ambitions.
Not only does it override the earlier agreement deposited by TNA and URP, but it also raises questions over the manner of UDF's declared exit from the alliance.
The clause pegged at the end of the document gives the TNA, URP, UDF Addendum powers over the earlier document signed by TNA and URP at Jeevanjee Gardens.
The document which reconstitutes TNA/URP coalition to include UDF as a partner, states among others:" In case of inconsistency between the Initial Agreement and this Addendum, the contents of this Addendum shall prevail".
Based on complaints
Ndung'u asked officials of TNA, URP and UDF to meet with her today to resolve the matter after UDF petitioned the Political Parties Tribunal over the breach of coalition.
On Saturday, Mrs Ndung'u confirmed calling the meeting, but declined to give details, only saying that it is tied to the issues raised by UDF in its complaint of breach of agreement.
"I will not discuss details of the planned meeting tomorrow (today) but it will be based on the complaints raised by UDF in its letter," said Ndung'u when contacted on phone.
The addendum titled "Coalition Agreement for National Healing and Reconciliation, Inclusiveness and Prosperity" was signed on December 4 and lodged with the acting Registrar on the same day, the deadline for pre-election coalition pacts.
The document in our possession states that the coalition can only be dissolved through mutual consent or after an irreconcilable breach filed and heard by Jubilee's dispute resolution team comprising members from the three parties and coalition partners.
The document amends clause 8 of the TNA/URP document on how to resolve disputes in Jubilee. It goes ahead to set up a dispute resolution team comprising five individuals, one each from TNA, URP and UDF.
Two others were to come from coalition partner parties to make a committee of five. The team of five was to come up with the chairman. However, the coalition did not survive long enough to appoint members of the team.
According to the document, the dispute team would deliberate and ask the offending partner to rectify the breach. However, it gives other options for coalition partners' parting off ways.
"Where the Dispute Resolution Council finds that there has been fundamental breach and or frustration of this Agreement then the Council shall either direct that the Coalition Partner in breach rectify the breach within such time as may be stipulated or it may determine that the Agreement is irreparably frustrated, in which case the aggrieved Party shall be at liberty to withdraw from the Coalition upon service of a three (3) months written notice", states clause 10(ii).
The amended clause in the Addendum further states: "Upon expiry of the notice period the aggrieved coalition Partner shall be at liberty to withdraw from the Coalition by informing the other Parties of the same in writing".
The document, which reconstitutes TNA/URP coalition to include UDF as a partner, states among others:" In case of inconsistency between the Initial Agreement and this Addendum, the contents of this Addendum shall prevail".
The implication is that unless UDF applies to leave the Union through mutual consent or "fundamental breach or feels frustration" after its grievances have been tabled and heard by Jubilee's dispute resolution team, the coalition still stands, complicating their activities as a union. The dispute resolution team was not in place when the parties disagreed.
Uhuru and Ruto later declared they had parted ways with Musalia and UDF through mutual consent, and went ahead to nominate Uhuru as their coalition's Presidential candidate.
On Saturday, however, Ruto's URP said it would not send any representatives to the meeting.
URP spokesman Aden Duale said the party was not interested with the arbitration process called by the registrar of Political parties.
He described the proposed meeting as a "sideshow" and declared that they would not be sending representatives. " We are not in that business and our mission is to deliver the presidency in the March 4 election. TNA and URP have a presidential candidate and a running mate and we are now working on rolling out campaigns to ensure we deliver the presidency. Anything short of that to us are sideshows and we will not engage in them.
He wondered why UDF was interested in the arbitration process yet Mudavadi announced on January 4 that he would launch his presidential bid and unveil a running mate.
Rejoin team
"TNA and URP have already moved on after the disagreement with UDF as Mudavadi did not want a competitive process in picking a flag bearer. It is up to them to rejoin our team and back Uhuru and Ruto or they contest on their own," added Duale.
On Saturday UDF insisted that despite writing to Ndung'u, it was not fighting to be re-incorporated into the Jubilee Alliance.
The party's Secretary General, Mr. Dan Ameyo, said they wrote to the acting Registrar to set a precedent so that in future parties would respect the sanctity of coalition agreements.
"Let no one assume that we are fighting so that we can be taken back into the Jubilee Coalition," said Ameyo.
He spoke as the party Chairman Hassan Osman announced they would hold their National Delegates Conference on January 4 at Bomas of Kenya to endorse Mudavadi as their Presidential choice.
In its letter to the acting Registrar, UDF accused TNA and URP of breaching the coalition agreement by failing to follow the correct process of ending their partnership.
But TNA Secretary General Onyango Oloo argued that Mudavadi pulled UDF out of the coalition by mutual consent.
Oloo confirmed that TNA had received the Registrar's summons and said they would attend the meeting.
"The Registrar is the custodian of all coalition instruments and we hope that she will make an informed decision on this case in the interest of Kenyans and all the three political parties. We hope the law will prevail," said Oloo.
The TNA official was conciliatory saying they wanted to ensure that they parted ways with their former ally (UDF) amicably.
"We do not want to go our different ways in acrimony as we may need together in future. We want to go our different ways as friends and we wish them well going forward," said Oloo.
The union ran into trouble less than a fortnight ago after TNA's Uhuru Kenyatta disowned another document he signed ceding his position as the coalition's flag bearer to UDF's Musalia Mudavadi.
Uhuru, Ruto, Republican Council's Najib Balala and Chirau Mwakwere visited Musalia's Riverside home to initiate the talks that resulted in signing of the secret deal and the Addendum. Ruto was to remain as the running mate of Musalia in that deal.
Uhuru later claimed he was coerced into signing the secret deal by powerful forces he refereed to as mashetani (demons).

have resigned en masse and had the commission reconstituted, but this is Kenya. That could not happen because;

conceivable why the TJRC could not invite written submissions, hold barazas while giving opportunities to those adversely mentioned to have their say and get over with it.

With the commissioners taking home over Kshs.0.8 million per month, why are you surprised that they keep on

Under the rule of natural justice,one should not be condemned unheard.After twists and turns TJRC is stuck,sought for more time so as to do its reports.
And in some News Reports today,there were sentiments for more time so as to have those mentioned time to be heard.
Should those who were mentioned ADVERSELY be given an opportunity to be heard (meaning more time + cash)? Or time be extended as requested by the commission for the compilation of the report? Or it was just another white elephant disturbing our mind and eating our coffers !
I am afraid if the status quo is manatined,we are likely not to see the report or if more time is allocated for those mentioned to be heard,we might either dilute what is so far in the hands of TJRC or "hear" those mentioned indefinately!

69 Cattle stolen while the farmer Claes Roempke was asleep!

According to the farmer, the 69 cattle disappeared on the night of the 19th December. The cattle have not been recovered upto this day.

The farmer is very concerned after the loss of his lively hood. ''Christmas was awful, I have to admit'' I honestly hope that the animals are alive and well. It is impossible that they could have escaped, for no visible trails have been observed, says Roempke. '' It had just started to snow on the 18th, such that it could have otherwise be an easy task to trace, had these cattle escaped.''

Over 200 heavily armed bandits made away with hundreds of sheep and goats on the eve of Christmas

Samburu, Kenya: Barely a month after bandits killed 42 police officers in Samburu, more than 200 heavily armed cattle rustlers have invaded and attacked Waso Ronkai village and fled with hundreds of sheep and goats.

The incident in Samburu North occurred at 11pm when the residents were preparing to usher in Christmas Day.

Three families were attacked in the incident. A Good Samaritan took three members of a family who had sustained serious injuries from Baragoi, where they could not access medical services, to Maralal District Hospital where they are undergoing treatment.

Doctors said they are out of danger. The more than 700 police officers currently stationed in Samburu North did not stop the raid despite receiving a report as the raiders fled with the livestock.

"The residents of Samburu North have strongly complained to the Government over persistent attacks and raids by bandits at Masikita and Kawap in Samburu North and the stealing of camels, cattle, sheep and goats from the area," said Lenkai Parsulai, a resident.

Insecurity

Fourty two guns were stolen from the police officers killed in Suguta valley in Baragoi and it is suspected they are now being used in the increased roadside robberies targeting those travelling for the Christmas holidays from Baragoi to Maralal.

Tension increased last week after bandits from Baragoi attacked Allamano village and police also recovered a mobile phone belonging to one of the police officers killed in Suguta valley in Maralal town.

The residents of Baragoi have again requested the Government to beef up security so that they can live peacefully. They fear schools will not re-open in Samburu North due to insecurity.

Police clash with residents over insecurity

NAIROBI; KENYA: Anti-riot police on Monday morning clashed with tens of Dandora residents in Nairobi who are protesting increased incidents of insecurity.
The residents are protesting Sunday night's killing of two people by armed thugs who were on a robbery spree.
The gang of three also shot and wounded one man in the leg. The two who were killed were robbed of their cash and other valuables.
Residents say the gang escaped aboard motorcycles, which were on standby.
Residents say the gang has been targeting them in the last days and want police to assure them there will be no more such attacks in the future.
The protesters later headed for Buruburu police station to complain there as anti-riot police watched from a distance but dispersed them.
Witnesses say the youths holding the demonstration are stoning motorists and robbing pedestrians. Other reports say two of the suspected thugs believed to be behind the attacks were early Monday morning killed by the residents.
Buruburu OCPD Hassan Barua who was in a meeting in Nairobi has been forced to leave to attend to the crisis.
A section of residents of Huruma estate in Nairobi on Sunday barricaded Juja Road to protest the killing of a businessman there by suspected thugs.
He was killed as he walked to his place of work within Kiamako area in the morning hours, witnesses and police said.
They barricaded Juja Road for a short while before police dispersed them using teargas canisters.
They also uprooted some kiosks in the area claiming they were housing criminals who are behind the attacks.
It took the arrival of anti-riot police led by Nairobi Area police boss Moses Ombati to restore calm in the area after they shot to the air and threw teargas canisters at the protestors who had blocked roads there.
One of the protestors claimed the attackers seem to target their community saying up to four people have been shot and wounded in the past three months alone in what seems to be systematic.
But police denied the claims saying the incidents are normal robberies being committed by local criminals who are out to get quick money.
Starehe OCPD Samuel Anampiu said police are looking for known criminals who are believed to be behind the attacks.
"The attacks are just normal but not targeting a particular community or group. We are looking for the gang behind them," he said.
The incident in the area came a day after a similar one in which residents of Mathare slums torched more than 30 houses to protest the killing of one of them.
The slum dwellers were angered by the stabbing of one of them by unknown attackers on Friday night before they descended on shanties they claimed were housing the said attackers burning them.
The arsonists stood besides the burning houses and even stoned police and fire engines that arrived there to save the situation.

NAIROBI, KENYA: Some Huruma estate residents in Nairobi on Sunday barricaded Juja Road to protest the killing of a businessman by thugs.
The victim is said to have been shot dead by unknown gunmen who escaped with the Sh50,000 he had with him and other valuables.
He was killed as he walked to his place of work within Kiamaiko area on Sunday morning, witnesses and police said.
This sparked protests by fellow businessmen and some residents, who claimed the attackers were known by police but they have not been arrested. Protestors barricaded Juja Road with burning car tyres before police dispersed them using teargas.
The angry mob also demolished some kiosks in the area, claiming they were housing criminals behind the attacks.
Systematic attack
It took the arrival of anti-riot police led by Nairobi Area police boss Moses Ombati to restore calm in the area.
One of the protesters claimed the attackers seem to target members of his community, saying up to four people have been shot and wounded in the past three months in what seem to be systematic attacks.
Another one said the attackers target meat traders in the nearby Kiamaiko market and appealed for firm action from police to prevent further attacks.
But police denied the claims, saying the incidents were random robberies by criminals in search of a quick buck.
Starehe OCPD Samuel Anampiu said police were looking for criminals who are believed to be behind the attacks.
"The attacks are random. They are not targeted at a particular community or group. We are looking for the gang behind them," he said.
Anampiu assured the protesters that they would beef up patrols in the area, especially at night.
The incident came a day after a similar one in which residents of Mathare slums torched more than 30 houses to protest the killing of a resident.
Stoned police

Police increased their patrols in the the area on Sunday amid rising tension to forestall retaliatory attacks by those whose structures were flattened.
Some of the victims have since re-constructed their houses.

Two plead innocence over 'Blood on gold'

NAIROBI; KENYA: Two businessmen adversely mentioned as having links with the alleged smuggling of Sh8 billion gold from the Democratic Republic of Congo (DRC) have come out to defend themselves.
Paul Kobia and Joe Kirimi say they had nothing to do with the deal adding that they have been vindicated by past investigations over the 2010 case.
They two said that they had not run away from authorities and were readily available if required by the police or anybody probing the gold smuggle.
"I am not above the law nor am I a fugitive who has run away from authorities. I am ready to face any investigations," Kobia told journalists in Nairobi on Monday.
A UN report has linked Kobia to the gold, while Kirimi's factory in Karen Nairobi was said to be the place where the gold smuggled was being smelted, a claim both deny.
Kirimi said he is in genuine business of precious metal smelting having been licensed by the department of mines and geology.
"My business in genuine and not illegal as it has been portrayed and even detectives led by CID director Ndegwa Muhuro have inspected my firm and cleared me," he said.
On his side, Kobia argued that he was vindicated earlier last year when police dropped charges against him after a complainant in the case failed to come and give evidence in court.
He further claimed innocence saying that his name was not among the 15 that were handed over to President Mwai Kibaki by his DRC counterpart Joseph Kabila.
On Monday CID boss Muhuro confirmed that Kirimi was in genuine business since his factory is licensed by the department of mines and geology and there was no complaint on him so far.
CID head of investigations, Mohamed Amin in February last year told the Standard that the complainant refused to come and police had since been told he had sworn an affidavit to that effect.
Kobia was arrested and charged on November 2, 2010 with pretending to sell 825kg of gold and obtaining $200,000 (Sh16.2 million) from a South African, Mr Dennis Ray Schmelzenbach.
Documents signed in November 2010 include a private sale and purchase agreement between Groupe Miniere de Kisangani (GMK) and Meranti Holdings Ltd Joint Venture-Hong Kong involving the initial trial shipment of 825kg of gold.
But in a sworn affidavit, the Chief Executive of Meranti Holdings Ltd Joint Venture-Hong Kong James Louis George said he has no complaint against Kobia.
"The company has not lodged any complaint at any time against Mr Kobia either with the CID Kenya or with the Kenya police nor is the company keen to pursue alleged complaint if any exists at all," reads part of the affidavit.
George asked for an order to lift the freeze in relation to the $200,000 to enable his advocates to act on business, which he is about to embark on in Kenya and Central Africa.
The affidavit was drawn by SS Jowhal and Company Advocates and sworn before Mercy Nyagah Advocates in Nairobi.
The documents explain Meranti Holdings Ltd Joint Venture-Hong Kong had retained the services of SS Jowhal in November 2010 and remitted the $200,000 as retainer in their escrow account at I&M Bank.
The investigations were being conducted by the CID, Immigration Department, Kenya Revenue Authority and detectives from DR Congo.
A KRA official who was leading the investigations, Joseph Cheptarus, was shot dead outside his home and no arrest has been made so far.

Rwandan President Paul Kagame has become an uncomfortable ally for the United States and the United Kingdom in Africa's Great Lakes region.
Rights groups are increasingly appalled at the support Mr. Kagame continues to receive from those who claim to be the leading defenders of human rights around the world, while at the same time providing support and cover for a man many consider a dictator, involved in war crimes across the border in eastern Congo, not to mention the suppression of any opposition to his regime by any means necessary.
Human Rights Watch, the Enough Project and the Open Society Foundations in Africa called this week on the United States to stop blocking a United Nations report containing evidence that top Rwandan officials, including Rwandan Defence Minister James Kabarebe and army Chief Charles Kayonga, have been supporting a new rebellion in eastern Congo led by infamous warlord Bosco Ntaganda, who is wanted by the International Criminal Court for war crimes.
A United Nations report released in 2008 provided evidence of direct links between the office of Mr. Kagame and rebels in eastern Congo led by Laurent Nkunda, Ntaganda's predecessor as commander-in-chief of the rebel CNDP. Although Nkunda is now said to be "under house arrest" in Rwanda, an interim U.N. report on DR Congo released on Friday says that Rwandan officials have allowed the former warlord to make phone calls to urge former CNDP rebels integrated into the Congolese army to defect and rejoin Ntaganda. The new unrest has led to the displacement of over 200,000 civilians.
Why would the U.S. and the U.K. continue to support such a man? Mr. Kagame, whose troops are credited with stopping the Rwandan genocide in 1994, has been able to cast himself as the guarantor of the country's stability and economic development. He has played the "genocide card" masterfully, promising gloom and doom if his regime were to fall. The Rwandan army has become one of the most powerful armies in the region, thanks in most part to military and financial aid from the United Kingdom and the United States.
Mr. Kagame has in return used the Rwandan army as leverage against his foreign backers. He has sent Rwandan troops as part of the African Union and United Nations force in Darfur. The A.U.'s force is supported by the United States.
Mr. Kagame successfully blackmailed the United Nations to remove the term "genocide" in a report released by the U.N. in 2010 that had initially said that the Rwandan army had committed genocide in reprisal attacks against Rwandan refugees who fled to eastern Congo after the genocide in 1994. All Mr. Kagame had to do to tame the U.N. was to threaten to remove the Rwandan troops from the A.U.'s contingent if the report was not watered-down.
As many critics point out, Rwanda's current relative stability has come at a very high price for civilians in Rwanda, but even more so in eastern Congo. The repeated Rwandan support to rebels in the region has led to theworld's deadliest war since World War II and the deaths of over 5,000,000 Congolese civilians. Far more innocent civilians have died in Congo, as a consequence of wars during the last decade, than the civilians who lost their lives during the Rwandan genocide.
Some have claimed that the U.S.' and the U.K.'s support to Mr. Kagame are driven by "guilt" for not intervening to stop the Rwandan genocide in 1994. The current U.S. ambassador to the United Nations, Ms. Susan Rice, was then a key advisor on Africa to President Bill Clinton. Ms. Rice has said that one of her biggest regrets was not doing more to intervene as the horrific events unfolded in 1994.
For Mr. Kagame to be given a license to kill and commit war crimes, 18 years after the dreadful events in Rwanda, because of "guilt" or military interests, is unconscionable.
How can the U.S. and the U.K. continue to claim they defend human rights and democracy around the world, especially in the Great Lakes region, while maintaining their support for dictators like Paul Kagame?
The U.S. has lost its credibility with many Congolese because of its continued support to Mr. Kagame, who most Congolese blame for the continued instability in eastern Congo.
U.S. President Barack Obama called Rwanda's meddling in eastern Congo a "pretext" in the first bill he sponsored after becoming a senator in 2005. Now a Nobel Peace Prize laureate, President Obama and the United States should make sure they live up to the moral high ground they say they represent. The United States' credibility and influence around the world depend on its actions rather than on words.

A contingent of police officers has been sent to Tana Delta District to hunt down abductors of an 80-year-old Pokomo elder.
Area police boss Richard Mukwate on Friday said Mr Abdalla Moyu had been abducted by Orma youths.
"Members of the two communities (Pokomo and Orma) have now resorted to guerrilla war tactics, where they strike their rivals at an opportune time," said Mr Mukwate.
According to the police boss, the old man and other members of his community left Semikaro for Shirikisho village to inspect the damage to their homes.
A group of Orma youths, who had been lying in wait, then struck. Shirikisho is one of the villages where homes were burnt down during a raid in September.
"Others escaped but Mr Moyu could not run due to his advanced age. He was abducted and there are suspicions that he was killed. We have sent a large contingent of GSU (General Service Unit) and AP (Administrative Police) officers, backed by others from the provincial headquarters. We are yet to find him or his body", said Mr Mukwate.
He said the officers, together with local leaders, combed nearby bushes but had not found the missing elder.
Tension heightened in the district as news of the abduction spread.
The police boss said earlier Orma fishermen had been robbed of two canoes at Daru crossing point by suspected Pokomo youths. However, two of the robbers had been arrested, he added.
At the same time, Mr Mukwate said an AP officer who went missing with a G3 rifle and 60 rounds of ammunition had not yet been found.
AP constable Reuben Mugambi Kinyua went missing after the December 21 clashes.
"We still don't know whether he drowned in the crocodile-infested River Tana or he is in the bushes. We are still looking for him", he said.
The sinking feeling of déjà vu following the senseless killing of at least 30 people in Tana River is a depressing statement of Kenya's dire security situation.
That the violent cycle of death and destruction has resumed with shocking ferocity, after a brief and clearly deceptive lull, should be an indicator strong enough that Government efforts to stem the bloodshed have failed woefully.
It should not be forgotten that the violence in the Tana Delta, largely featuring individuals from the Pokomo and Orma communities, has a history strewn with scenes so tear-jerking that even scriptwriters of horror movies would find hard to imagine.
The worst was reflected in numerous tit for tat inter-communal raids early this year that left more than 100 people dead, hundreds injured, property destroyed, and livelihoods disrupted. The ruthlessness of the attacks spared no helpless little child or hapless woman. Indeed, the brazenness and level of organisation of the criminals hiding under the convenient cloak of their ethnic groups was so extraordinary that they even killed security officers and got away with it.
Despite widespread media and civil society reports of the actual or impending violence at the time, the Government, whose unambiguous responsibility it is to ensure the security of its citizens, showed incredible reluctance to firmly deal with the matter.
Instead, security agencies were reduced to showing up to count body bags after the criminals had done their deed, while the sacking of chiefs for supposedly failing to stop the raids became a convenient scapegoat.
When the Government finally decided to take decisive steps to restore law and order, it was apparent that law abiding residents of Tana River could not be blamed for feeling let down.
One would, therefore, expect that the deployment of more police officers, including the crack General Service Unit in August, and the establishment of a Judicial Commission of Inquiry to investigate the root causes of the Tana Delta clashes would be complemented with enhanced intelligence gathering and reconciliation exertions. Behaving as though these are mutually exclusive strategies can only be foolhardy.
But on the evidence of yesterday's brutality, it appears the Government has once again been caught in deep slumber. How and why such an elaborate crime would be schemed and executed right under the noses of various security agencies are questions that the President, the Prime Minister and the Internal Security Minister should find appropriate to answer.
It may be irrelevant to the 30 or so corpses, but taking decisive action to end the madness in the Tana River region is a matter whose urgency cannot be gainsaid.
Scripted empty rhetoric and executive tears from top politicians and Government officers upon landing in the affected area – before quickly flying out and forgetting the godforsaken place until the next tragedy – will no longer persuade even the most naïve among us.
Neither will the usual blame game, whose common denominator is pointing fingers at local politicians for incitement and citing longstanding hostilities, be enough to break the cycle of violence.
Instead, it is important for the work of the Judicial Commission of Inquiry to continue alongside a robust security operation and genuine reconciliation efforts to narrow the perceived gaps between the Orma and the Pokomo. Without putting too fine a point on it, never again should such death and destruction be allowed in Tana River.
On a broader milieu, the insecurity in the Tana Delta dovetails into the all too familiar situation the country is currently experiencing. Truth be told, no country can claim to have the ability to reduce the crime rate to zero.
Nonetheless, the regularity with which criminals are roaming our land and executing their nefarious acts could only mean that the security apparatus is out of its depth. Let us hope the impending appointment of the police top command will trigger a return to the drawing board.
Be they suspected terrorists in Nairobi, cattle rustlers in northern Kenya or hate-filled raiders in Tana River, we insist that such lawlessness should never be allowed to be a way of life.

Anti-corruption body averts Sh1.2b loss

The Ethics and Anti-Corruption Commission (EACC) averted loss of Sh1.2 billion in the past one year.
In its annual report, EACC stated that it had also traced four illegally acquired assets with an estimated value of Sh126.5 million.
"The Commission averted the loss through proactive investigations at the several cases at the Kilindini Port in Mombasa, Mumias Sugar Company, City Council of Nairobi, District Education Board in Kakamega South District, Kenya Revenue Authority in Embu, National Social Security Fund, Mariakani Weighbridge and Ministry of Lands," the report stated.
The Commission also recovered public assets including Mombasa's Uhuru Gardens, valued at about Sh500 million and land belonging to KARI valued at Sh20 million.
The Commission's Annual Report of Financial Year 2011 – 2012 highlighted significant milestones it has achieved as it transited from Kenya Anti-Corruption Commission (KACC) to the EACC.
EACC also stated that the number of corruption cases reported increased to 42 per cent from 34 percent in the previous year.

Also the figure given may sound big but it may be a tip of an iceberg. We have seen some public officers become billionares in the last five years and you wonder how they have acquired this enormous wealth within a very short time. Finally this agency is doing Kenyans a disservice by not naming those who held the illegally acquired public assets and those who were trying to steal public funds.

Tana killings a serious indictment of security agencies

The dawn massacre of over 20 people in Tana River and the retaliatory attack that upped the unfortunate tally to 45 have left the country baffled as to how the security forces in the country work.
First, it was clear even to the villagers that an attack was impeding. It was, therefore, almost a foregone conclusion that the intelligence and the police would avert more bloodshed. Why did they not stop further bloodletting, or were they tacitly complicit in the attacks?
The trouble with this careless handling of national security, as it were, is that it may push the various communities at the Coast and elsewhere to the assumption that the State is unable to defend its citizens, with catastrophic effects to our efforts at forging a united, organized Kenyan society from a diversity of previously disparate ethnic nations.
That the Tana massacre came just four months after another attack that claimed over 116 people, including nine police officers, is scary.
One would have expected that the whole region would be under the national security microscope considering that we are slightly over two months away from the next General Election.
In fact, vast sections of Tana River area have been under curfew, which gave the impression that the security of the area was under control. At what point did the police drop their guard?
The other eerie fact is that the latest attacks took place just a short distance from a GSU patrol base and shortly after a reconciliation meeting at Kipao.
As Muslim for Human Rights (Muhuri) and other stakeholders have pointed out, there may be a clear political hand behind the clashes which needs to be investigated and those behind the massacre be made to face the law.
This is the only way we can stem the wave of impunity that seems to be at work here; where multiple attacks can be staged within months of each other, perhaps because the perpetrators are buoyed by the fact that no one has ever been brought to justice in a country whose election cycles are coextensive with senseless waves of violence.
As the country ushers in a new system where the police will be under an independent Inspector General, one expected that we would be more secure because the police service has constitutionally been given the autonomy to ward off political manipulation.
Simply put, the attacks are a serious indictment of the ability of the Internal Security ministry to handle national security at a crucial period in Kenya's history.
We hope the Inspector General, once in office, will reverse this worrying trend and ensure we have a peaceful country as we head to the polls.

Hundreds of people fearing a government backlash over the killing of at least 32 police officers are fleeing their homes in north-western Kenya as the military prepares to help police pursue the bandits who carried out the attack, officials have said.
Police Commissioner Mathew Iteere said a "serious" operation has begun to find those responsible for the deaths of the officers over the weekend.
"We cannot allow such things to happen. I think they were testing the waters and in due cause they will know the depth of the river," he said.
The national security council, chaired by President Mwai Kibaki, said the military would provide support to the police in apprehending the bandits and recovering stolen animals and arms in Samburu county.
Residents in Baragoi, the main town in Samburu North district, said there had been a big build-up of police officers in the town.
The police were killed over the weekend after being ambushed by bandits from the Turkana tribe, who are suspected of having stolen cattle from the Samburu tribe.
Samuel Letipila, a council representative in the affected area, said the bodies of 34 police officers and reserves had been recovered. Iteere put the confirmed death toll at 32 with several officers missing.
Letipila said he lost 112 cattle in mid-October when Turkana raiders stole more than 500 of them. Twelve Samburu warriors were killed on 30 October when they attempted to recover their animals from the Turkana. Those killings led to last weekend's police operation, he said.
Francis Karimi, a local government official in Baragoi, said nearly 1,500 members of the Turkana community had fled from Lemerok village fearing the approaching government operation. Karimi said residents had been seen leaving in buses with their mattresses and boxes of household goods. "They are afraid," Karimi said.

Police officer killed in Mandera attack

Mandera, Kenya: A police officer was Thursday night shot dead and robbed his rifle in an attack by suspected militants in Mandera Town near the volatile Kenya-Somalia border.
The police constable was on foot patrol with his colleague at about 9 pm when they were confronted and ambushed by three men armed with pistols.
Police say the victim was shot in the neck and chin at close range and was pronounced dead on arrival at a local hospital.
The other officer escaped unhurt after he ducked into a ditch and engaged the gunmen in a shoot out. The gang picked the officer's G3 rifle and escaped with it but dropped the magazine that had 19 bullets.
The killing of the police officer is the latest incident targeting security agents and other government officials in the larger North Eastern region.
More than two dozens of security agents have been killed and similar number injured in well coordinated attacks believed to be staged by Somalia's Al Shabaab militants.
Police had been on high alert during the Christmas Holidays following reports that the militants planned a major terror attack on churches and other social joints and even kill and injure them.
North Eastern police boss Philip Tuimur said no arrest has been made in regard to the Thursday night attack but added security has been beefed up to avert such incidents.
Police say terror threats are still rife and are calling for public vigilance.
Officials say a message intercepted from the Somali Islamist extremist group Al Shabaab shows the rebels are being offered up to Sh890,000 to kill Kenyan security officers.
Garissa County Commissioner Maalim Mohammed said the rewards are enough incentive to motivate some youths in the eastern Kenyan county to carry out attacks against Kenyan army and police.

Leaders claim politicians fuelling attacks

Leaders and human rights agencies have claimed politicians seeking to influence polls in the county were behind the latest killings in Tana River Delta.
They also censured the Police and Internal Security minister Katoo ole Metito for the rise in insecurity.
Meanwhile, intelligence sources told The Standard On Sunday last evening that retaliatory attacks were imminent as ethnic Orma who lost more than 20 kinsmen have threatened to revenge against Pokomo. The intelligence sources also revised the death toll to 45.
"Some prominent political leaders who are seeking top positions in Tana River County fear losing the polls next year and now they have turned to crude ways of scaring the people to flee the area so as not to vote," claimed Tana River County Council chairman Salim Golo who is also Garsen Ward councillor.
He said the Friday attack, curiously, came a day after a reconciliation meeting held in Kipao village.
Muslims for Human Rights (Muhuri) Executive Director Hussein Khalid, said the minister should explain how the massacre of 45 villagers could be committed a few kilometres from a GSU patrol base.
Mr Khalid also alleged that some of the attackers wore police uniform while one of those slain by villagers is believed to have been a security officer. The official claimed that GSU officers visited Kipao two days before the massacre and said there was a political hand in the violence.
"Muhuri is perplexed by the killings of tens of people in Kipao village of Tana River County. This is despite the presence of hundreds of GSU personnel in the region who were in the area to promote peace and stop the killings," Khalid said in a statement to The Standard On Sunday.
Muhuri suspects the violence is associated with up coming elections in Tana River County.
"We suspect there could be political forces trying to displace voters from Tana River and adjacent areas including Lamu and Malindi," Khalid said and added that the Internal Security minister must explain pressing questions.
"Clearly, we cannot sit and watch as those placed in places of authority fail to do their work. That the minister has failed to protect lives and property which are his core duties leaves him with no choice but to step aside," he said.
Meanwhile, Kipao village is believed to be the most densely populated settlement in Garsen constituency. However, these claims have not been independently confirmed by The Standard On Sunday.
According to Golo the village has over 100 households.
"Kipao village is one of the largest villages in Garsen constituency and it has over 100 households thus carrying a bigger number of people in the area and for that case it could be targeted politically," said Golo.
According to statistics from the Independent Electoral and Boundaries Commission (IEBC) Garsen constituency registered 28,714 voters at the just concluded exercise with Kipao having 1,550, one of the largest concentration of voters in the constituency.
Other constituencies in Tana River County are Galole with 19,374 and Bura with 24,949 voters.
IEBC North coast region coordinator Ms Anasaticia Mutua said many people lost their IDs during the clashes which occurred in Kilelengwani and Kipini in August and September hence could nor register as voters.
Recently the Government deployed GSU officers in Tana River Delta following the massacre of 116 people including nine policemen.
The killings forced the Government to impose a dusk to dawn curfew in the whole Tana Delta as part of security measures aimed at containing tensions and confrontations among residents.
Villagers dislpaced by the violence were forced to camp at at Witu, Tarasa and Dida Waride.
Galole MP Dadho Godana was charged in court in connection with the clashes.
Godana allegedly called for the removal of Defence Minister Yusuf Haji from the Internal Security docket failure to which there would be no peace in Tana River.
He was accused that on September 11 at Kilelengwani village in Tana Delta District, he uttered words to the effect "I am sure, I am certain that you are yet to see more, if Haji is not sacked from that docket."

KENYA: Trouble is simmering in Kenya's northern frontier following the discovery of substantial oil deposits in several drilling sites in Turkana County, as communities dig in for fair share of the resource, it has emerged.
While transparent management of the resource could lead to greater prosperity for communities, as witnessed in oil producing western states like Russia and Sweden – mismanagement of the resource and corruption could result in tragedy like in the Niger Delta in Nigeria and the Sudan.
Tullow oil, the company entrusted with oil prospecting in the region, announced early this year that it had struck oil in two sites in Turkana namely Ngamia (I) and Ngamia (II), adding that the area had potential for vast mineral oil deposits.
But the prevailing legal and policy vacuum on resource sharing and compensation for affected communities – and lack of civic education and sensitisation – is a breeding ground for chaos, experts warn even as community members questioned the rationale behind continued hiving off of their land without their consent.
Geology Bill
Although the draft Geology, Minerals and Mining Bill and Policy 2012 seeks to provide a strong legal and institutional framework to develop the sector and create value for stakeholders – under the provisions of the draft Bill, local communities will get five per cent royalties for minerals from their area, and 20 per cent to the county while 75 per cent will go to the central government, it has been faulted by some stakeholders for falling short of the provisions of the Constitution.
Constitution Implementation Commission chairman Charles Nyachae told a parliamentary commission that provisions of the Bill did not seal all fault lines for corruption.
He added it was not clear who should own newly discovered minerals or what happens if minerals are found on private or community land. The Bill is now awaiting parliamentary approval.
Bill amendment
"I was rather surprised the Bill was presented to Parliament as it were when it had been thrown back to the Ministry of Environment and Mineral Resources to amend it," says Prof Paul Syagga, a land economist and lecturer at the University of Nairobi, Department of Real Estate and Construction Management. "The Bill is replete with myriad flaws, which needs to be addressed to align to the constitution.
"For the moment though, issues arising from oil prospecting and exploitation in the North would have to be addressed by provisions in the Constitution and National Land Policy," he added.
As the legal impasse persists the Turkana community came out fighting vowing to fight to the end to defend their land and ensure equity in sharing of the resource.
"We are under siege since the oil was discovered," said Mzee Peter Ejore when he spoke to The Standard On Sunday during the World Human Rights Day Celebrations in Korogocho slums in Nairobi, early this week.
Swathes of land
"Strange people come and fence off huge swathes of our land without telling us what is going on. Our leaders and the Government also do not explain to us," he added.
He says the community is in the dark over the contractual arrangement between the oil company and the Government, adding that their fate is uncertain.
"All a Turkana knows about is his animals and grazing land. They are talking about compensation and sharing.
"What compensation would let me let go of cows? We can see they are taking a few children to school through devolved funds, but how do you equate this to our livelihoods and heritage," he observes. According Benson Elim a member of the Turkana Professionals Association, misunderstandings and lingering economic and security issues need to be addressed to avoid the oil blessing becoming a curse.
"We need the Government to address issues affecting us in a sound and legal framework. We have been in conflict with neighbouring countries decades over resources," observes Elim.
"Now we are reliably informed that oil has been discovered in Lake Turkana and Ethiopia is busy constructing a dam across the main tributary to the lake. We depend on the lake for water for our animals and fish for our substance, what happens to us if it dries up or it becomes an oil rig," he adds.
Indeed with the discovery of oil and minerals in other parts of the country many are keenly watching the extent to which the provisions of the Constitution will be effective in protecting and enhancing the rights of the local people in whose areas those resources are found.
It will be interesting, for example, to see how the new Constitution will deal with the well-documented concerns that discovery and exploitation of resources always turns out to be a curse especially to the local community.
The manner these concerns are being negotiated and agreements signed will also bring into sharp focus the roles of the different institutions that have been established by the Constitution.
Starting with the issue of local communities one of the critical areas that must be comprehensively addressed is the implication of the constitutional provision that requires Parliament to enact legislation ensuring that investment in property benefit local communities and their economies.
Concession agreements
No such legislation has been enacted and yet the Government is busy executing concession agreements with various foreign companies to exploit resources on community land.
Questions therefore arise as to what extent are local communities being involved in these agreements and are these agreements in line with the Constitutional provisions? Is there need to have a clear formal impact and benefit agreements with the local before such companies are allowed to start their operations?
At the institutional level the question that arises is the role of the yet to be gazetted National Land Commission.
According to the Constitution all minerals and mineral oils fall under the definition of public land. Such land is to be administered by the National Land Commission. Under what constitutional or legal authority are the various government institutions entering into such agreements?
Are these government bodies acting beyond their constitutional power in executing these agreements?
Syagga, is adamant the policy and contractual agreements should be explicit on how the resources would be shared between the investor the government and the communities.
"I now hear that 90 per cent of the proceeds would go to the prospector for a good period of time until their recoup their investment. Ten per cent will be shared between the central government and the community. But how much would the profit be and how long will take the investors to recoup their investment. And if the sharing should factor in community social responsibilities like building schools and hospitals then presumably the benefits will reduce significantly, then what else will the community benefit," he poses.
Resettlement plan
He however challenges the government to come up with come up with a sound resettlement plan for the communities by procuring alternative land and provide re-location benefits.
"The compensation should be fair and prompt to ensure communities are disadvantaged. However, development is in the interest of the public and the government has every right to exploit a resource such as oil.
These things affect people the world over and without people giving way for development the industrial revolution would not have taken place, all that needs to be done is for the communities to be sensitised," Syagga says.
Police officer killed in Mandera attack

Mandera, Kenya: A police officer was Thursday night shot dead and robbed his rifle in an attack by suspected militants in Mandera Town near the volatile Kenya-Somalia border.
The police constable was on foot patrol with his colleague at about 9 pm when they were confronted and ambushed by three men armed with pistols.
Police say the victim was shot in the neck and chin at close range and was pronounced dead on arrival at a local hospital.
The other officer escaped unhurt after he ducked into a ditch and engaged the gunmen in a shoot out. The gang picked the officer's G3 rifle and escaped with it but dropped the magazine that had 19 bullets.
The killing of the police officer is the latest incident targeting security agents and other government officials in the larger North Eastern region.
More than two dozens of security agents have been killed and similar number injured in well coordinated attacks believed to be staged by Somalia's Al Shabaab militants.
Police had been on high alert during the Christmas Holidays following reports that the militants planned a major terror attack on churches and other social joints and even kill and injure them.
North Eastern police boss Philip Tuimur said no arrest has been made in regard to the Thursday night attack but added security has been beefed up to avert such incidents.
Police say terror threats are still rife and are calling for public vigilance.
Officials say a message intercepted from the Somali Islamist extremist group Al Shabaab shows the rebels are being offered up to Sh890,000 to kill Kenyan security officers.
Garissa County Commissioner Maalim Mohammed said the rewards are enough incentive to motivate some youths in the eastern Kenyan county to carry out attacks against Kenyan army and police.

Up to 100 legislators are affected following passage of new elections law

KENYA: Next week will see mass resignations of Members of Parliament ahead of the deadline on January 4.
Led by a host of presidential aspirants and well-known politicians, over 100 MPs would be forced to resign their seats after abandoning the parties that sponsored them to Parliament.
They include Deputy Prime Minister Uhuru Kenyatta who jumped ship from Kanu and founded The National Alliance (TNA), and his Jubilee Alliance partner Eldoret North MP William Ruto, who is now in the United Republican Party (URP), from ODM.
Ruto wrote to the acting Registrar of Political Parties, Lucy Ndung'u, on December 21, and formally joined URP on December 23.
Uhuru resigned from Kanu on December 22, and joined TNA.
Foreign Affairs minister Prof Sam Ongeri has abandoned Kanu for TNA.
Watching from the sidelines will be Prime Minister Raila Odinga (Orange Democratic Movement) and Vice- President Kalonzo Musyoka (Wiper Democratic Movement).
The two alongside many MPs have stuck to the parties that elected them to Parliament.
Good riddance
Most affected are the Party of National Unity (PNU) where a majority of MPs have moved to TNA, with a few going to other parties, rendering the party that sponsored President Kibaki to State House virtually moribund.
ODM will be saying good riddance to a host of MPs from the Rift Valley who joined Ruto in URP, even as they kept membership of the party that sponsored them to Parliament.
The Political Parties Act bars individuals from belonging to more than one political party at the same time.
Uhuru and Ruto had to relinquish membership of the parties that sponsored them to Parliament before they could be given the mandate to run for president under the umbrella of the Jubilee Alliance.
The law requires that MPs who want to resign write to the Registrar of Political Parties, the Clerk of the National Assembly, and the political party they are defecting from.
Though January 4 is the deadline for the resignation from their current parties, the MPs would be expected to resign by Monday, December 31, if they are to make it to party membership list to be deposited with the Independent Electoral and Boundaries Commission (IEBC).
Surprises are not to be ruled out, however, as many MPs keen on returning to Parliament will be choosing parties they believe can boost their ambitions.
Among those affected are Deputy Prime Minister Musalia Mudavadi (ODM to UDF) and Peter Kenneth and Eugene Wamalwa (both from PNU to Kenya National Congress and New Ford- Kenya).
Ruto will also be resigning this week officially from ODM to URP, along with about 50 MPs who are allied to the Jubilee Alliance.
Most of those affected are from the TNA wing of the alliance. Some like Trade Minister Moses Wetangula and Noah Wekesa have moved from PNU to Ford-Kenya are in the Coalition for Reforms and Democracy (CORD).
Also affected are Cabinet ministers Samuel Poghisio from Wiper Democratic Movement to URP, and Chirau Ali Mwakwere from PNU to URP.
Other ministers are Kiraitu Murungi from PNU to Alliance Party of Kenya, Njeru Githae (PNU to TNA), and Amos Kimunya (PNU to TNA).
Also affected are Esther Murugi, Beth Mugo Jamleck Kamau (PNU to TNA), Naomi Shaban and Yusuf Haji (Kanu to TNA), and Soita Shitanda (PNU to United Democratic Forum).
Joe Nyagah, an ODM nominated MP quit the party for TNA, as did MP Rachel Shebesh and Webuye MP, Alfred Sambu, who moved to UDF.
The resignation will leave President Kibaki's PNU on its knees, as MPs dash out of the party.
The mass resignation is likely to affect House business given that Parliament's term expires on January 14, after the MPs would have resigned.
Avert a crisis
But some MPs are toying with the idea of amending Elections Act to move forward the deadline for resignations and avert a crisis in Parliament.
Joint Government Chief Whip and Gem MP Jakoyo Midiwo has drafted an Amendment Bill that seeks to have the membership list submitted to the IEBC 50 days to the General Election.
"I will address this (problem) through an amendment to the Elections Act tomorrow (today)," said Jakoyo.
Parliament resumes its sittings this afternoon and among the Bills to be discussed in the Statute Law (Miscellaneous Amendments) Bill, which also contains amendments to the Elections Act.
The Bill is an omnibus law that seeks to amend several statutes.
Uhuru and Ruto have since written to Kanu and ODM, as the law requires, announcing their defections to TNA and URP.
Kenneth and Wamalwa have also separately written to the PNU secretary general and the Registrar of Political Parties stating they had defected from the party.
"I am against any attempt to extend the timelines by two weeks as is being pushed for by some MPs. We should stick to the deadlines as they are now so that we can begin the contest," said Peter Kenneth.
Allied to party
Uhuru, who is the presidential candidate for the Jubilee Alliance on Sunday, said he had resigned from Kanu.
Over 100 MPs allied to these parties are expected to follow suit and hand in their resignations.
The vacancies would, however, not occasion by-elections as they are coming within three months to the General Election, but will affect parliamentary business.
The law prohibits by-elections within three months to the General Election, making it impossible for IEBC to declare the seats vacant and for the Speaker to issue writs to necessitate by-elections.
Although the Elections Act is silent on party hopping, all parties are expected to present lists of their members to IEBC by Friday, next week.
"The Act does not stop party hopping directly, but if your name would not be on the lists to be presented to IEBC before January 4, then you will not be eligible to vie for any elective post in the elections," said Kanu Secretary General Nick Salat.
"A political party that nominates a person for any election under this Act shall submit to the commission a party membership list of the party at least two months before the date of the General Election," states Section 28 of the Elections Act 2011.
"I am ready to enroll as KNC party member by tomorrow (Friday) if the resignation from PNU would have been processed," Kenneth told The Standard yesterday.
Kenneth said that KNC had not been keen to attract sitting MPs as members as it was clear that in elections 80 per cent of legislators rarely retain their seats.
Party euphoria
Wamalwa also said he had formally informed PNU and the acting Registrar of Political Parties of his defection.
"I have written to PNU and the registrar stating that I have switched to New Ford-Kenya, in which I intend to formally register in the New Year," Wamalwa said.
New Ford-Kenya has set up a National Elections Board and is preparing the ground for nominations.
The Justice and Constitutional Affairs Minister revealed that nominated MP Musikari Kombo, former Ambassador and Cabinet minister Kipruto Kirwa and former Livestock Development Permanent Secretary Kenneth Lusaka have also enrolled in New Ford-Kenya.
"We have attracted a new crop of leaders with integrity and the support from the grassroots as opposed to the party euphoria, which some MPs expect to ride on in the March 4 General Election. We will field candidates in all elective positions," Kenneth said.

A complementary measure of the unreported economy is the "tax gap", namely the difference between the amount of tax revenues due the fiscal authority and the amount of tax revenue actually collected. In the U.S. unreported income is estimated to be $2 trillion resulting in a "tax gap" of approximately $450–$500 billion in loses to the Government.

The "unrecorded economy" consists of those economic activities that circumvent the institutional rules that define the reporting requirements of government statistical agencies. A summary measure of the unrecorded economy is the amount of unrecorded income, namely the amount of income that should (under existing rules and conventions) be recorded in national accounting systems (e.g. National Income and Product Accounts) but is not. Unrecorded income is a particular problem in transition countries that switched from a socialist accounting system to UN standard national accounting. New methods have been proposed for estimating the size of the unrecorded (non-observed) economy, but there is still little consensus concerning the size of the unreported economies of transition countries.

The "informal economy" comprises those economic activities that circumvent the costs and are excluded from the benefits and rights incorporated in the laws and administrative rules covering property relationships, commercial licensing, labor contracts, torts, financial credit and social security systems. A summary measure of the informal economy is the income generated by economic agents that operate informally. The informal sector is defined as the part of an economy that is not taxed, monitored by any form of government, or included in any gross national product (GNP), unlike the formal economy. In developed countries the informal sector is characterized by unreported employment. This is hidden from the state for tax, social security or labour law purposes but is legal in all other aspects. On the other hand, the term black market can be used in reference to a specific part of the economy in which contraband is traded.

Pricing

Goods acquired illegally take one of two price levels:

They may be cheaper than legal market prices. The supplier does not have to pay for production costs or taxes. This is usually the case in the underground economy. Criminals steal goods and sell them below the legal market price, but there is no receipt, guarantee, and so forth.

They may be more expensive than legal market prices. The product is difficult to acquire or produce, dangerous to handle or not easily available legally, if at all. If goods are illegal, such as some drugs, their prices can be vastly inflated over the costs of production.

Black markets can form part of border trade near the borders of neighboring jurisdictions with little or no border control if there are substantially different tax rates, or where goods are legal on one side of the border but not on the other. Products that are commonly smuggled like this include alcohol and tobacco. However, not all border trade is illegal.

DEVIL WORSHIPERS CANNOT BE TRUSTED, THEY FAILED GOD AND THEY WILL FAIL MAN TOO (FOR IT WAS PREDICTED AND WRITTEN LONG AGO)

Devil Worshiper are recruited by Satan's Army and Agents. They are therefore against any protracted Reform Accord expected to benefit the people…..and so they will continue to gang with like minded to destroy Peoples Mandate and make sure Public Mandate deliveries fail to work except for their Special Interest. This is one fundamental factor why it is not desirable or feasible to engage the Devil you know at whatever cost to even come close to trusting them.

Hear me people and hear me well. We must fight for justice. It is a worthy fight and God in His Mercy shall carry us through it, because He promised us the best, and His promise is real. To those who have done wrong must face justice and two wrongs cannot make a right.

Remember, God rejected Satan because he is a liar who failed the test of God Almighty. We must not fear Satan because he is evil and his ways are also evil. Satan comes to steal, kill and destroy. Satan uses his demonic power to influence people to engage in the wrong ways; those of destruction to nature with extinction to the environment causing pollution to vitality of freshness of air, water and nature including the destruction to mankind since without air or water, there is no life. His evil nature brings trouble, pain and sufferings to God's Creation, which is why he is doomed. His evil ways have taken toll in Kenya today. Satan in his dominion have authority over his members and with principalities are roaring all over the world. They have their tools strategically and dangerously placed targeting the innocent and are looking for each and everyone to devour. Their behaviors' look-alike, for which they are known as Devil Worshipers since they belong to Satan's mission of the devils' member club. Those who are Satan's recruit do evil wicked things, they have no feelings nor do they care about human empathy and sufferings. They brutally attack, plunder, kill and destroy people's livelihood and survival. They are selfish and greedy wanting everything for themselves; even those that do not belong to them. They collude in a conspiracy to illicitly take people's properties fraudulently and in an organized theft, they collaborate to steal people's cows as and con their way taking food plantation from unsuspecting innocent people; which they sell to profit thereby forcing people to extreme poverty and drive others to migrate from their homes and communities. They have no shame as they belong to the mark of the beast.

Beware, be wary and take caution……….God did justice to Satan and separated him from the good Angels. People Satan is doomed with his agents and principalities and they all belong to hell. Suspects of wrong deeds who are found wanting must face the Law, factors of Reform justice. But to those who wish to support the change we all want, there is remedy and they shall be known by their deeds where, in checks and balances (According to Reform Tenets) and through threshold of Transparency with Accountability their Responsibility with Integrity will speak loud and clear for themselves.

We have to fight a just war and stand for our Rights, condemn them with their evil ways and we must stand up for them to face justice and expose all their ways. People, Government is for the people and it is to provide services to the people fairly in a balanced manner. Government services are for sharing and caring for all without discrimination. Good things therefore come from God, and God will see us through to achieve peace united under love which will bring us good tidings……..but all that is evil come from Satan and we cannot choose to join Satan's evil ways, which will mean joining Satan in his doomsday and which is after destroying our livelihood and survival and ending nature from environmental pollution the wicked, Devil worshipers are presently engaged.

It is only if and when they turn away from their evil ways and recognize fairness and justice that benefits life in fair sharing; is when we can come to terms and agree to dialogue in the best ways we must form Partnership sharing fairly (In Give and Take) the Gifts of God in this beautiful world God gave to all of us, so that when our time is ended on earth, we shall have left this world a better place than we found it.

After election was stolen and things went haywire in 2007/8 where many people were killed and innocent lives and livelihood were destroyed and terminated; and after the political conflicting groups could not agree or compromise by themselves; Eminent leaders led by Kofi Annan intervened and Reform Accord Agenda to deliver Public Mandate effectively and efficiently was established which brought the birth of Coalition Government of Kenya that is about to end in December 30th 2012. The Coalition Government was mandated to formulate and Legislate the New Constitution for which the core value why extra-judicial killings of 2007/8 was the bone of contention and for which they took Oath of Office and swore to uphold has not been realized to-date. What has taken shape instead is, politicians joined with those who manufactured Economic Crisis, sold public corporations, facilities and utilities, engaged in dangerous theft and thuggery of the world, created organized thugs and gangs in the likes of Mungiki and connected them with International Mercenaries that terrorize people who introduced and are working alongside pirates in the Sea-Shores of the world and who engage in money laundering and all forms of International Off-shoring of Finance Trading including trafficking of Ponzi schemes, Pyramid schemes, and Hedge funding to defraud public wealth and transfers of illicit finances; the invasion of natural resources, land and water towers, human organ trafficking and child prostitution and introducing back-door slavery, joined in Drug Trade and Trafficking while deeply engaging in high level of Corruption, impunity and graft. They extended to manufacture Vision 2030 to join with demises of why Haile Selasie Mariam sold Ethiopia and ran to exile where he finally died while people are left hostages to which the Oromo of Ethiopia are left wondering to-date after they were driven out of their homes and villages. Today, the same picture is portrayed by East African Political collaborators, engineers and manufactures of Economic Crisis of the likes of former President Moi created the Mungiki for Uhuru project and recruited Kibaki, Raila, Museveni and Kagame. Their boot soldiers are doing the terrorism to fail the Reform Accord that people approved at the Referendum. It was the peoples voice and vote that brought Reform to the table to formulate the Coalition Government. It is the people who stand to suffer as victims of the manufactured Economic crisis by the Network and collaborators of the ("Clean-Up" Greedy and Selfish) unscrupulous International Corporate of Special Business Interest who want things for free evading paying Tax Revenues, who steal public wealth and resources, who constantly terrorize people from living a meaningful dignified livelihood in an organized democracy and who engage in forcing people out of their livelihood by force using crooked lawyers who with the appointed court Judges twist and pass judgments in their favor cannot be left to continue. It is the people whose determination will bring the change we all want………..and this cannot wait for too long.

People we must let the Coalition Government leaders term to expire because we have a right to fire the whole of Coalition Government with their Team and improve Reform panel for fresh election after they are gone.………. So that we are able to face the world boldly sharing development ideas that works for common good of all and formulating them to benefit all shared fairly without intimidation, manipulation, terrorism, corruption, graft or impunity. If we were committed to Referendum, we can make it now that Kenya is at crossroads and things don't seem to work to the advantages of Reform Accord we struggled for so much.

If Evil Worshipers members of Satanic Group (those who engage to destroy Economic Stability of the world for the sake of Greed and selfishness) took oath to Network and collaborate to protect each others interest as Members of a Team, where they plan to kill, terrorize and steal from the Public Wealth and resources and from innocent people; have agreed to protect each other's back from blame or Legal Justice; have conspired to sell the Nation …….How can you trust any amongst them to Change or Reform to do the will of the people, to delivery public mandate before the Jurisdiction from Court of Law Justifies and clears them and give them Clean Bill of Responsibility and of Integrity sufficing Public Service Delivery…….???

We must engage to do the right thing people……….We must stop the organized terrorism of our local community, we must stop stealing of the local poor people's cows, we must stop the intimidation of forceful eviction of people from their homes destroying people's livelihood and survival with environmental pollution and commit to engage Reform Accord we struggled to achieve.
