Ngupula umeongea vizuri sana ndugu yangu yaani ungekua jirani ningekupooza walau na ka-pepsi. ila nadhani tusaidiane kitu hapa. Naomba Fratern, Ngupula,Mhangwa mniunge mkono kwa pamoja tuombe Ndugu Makame Idd walau ufafanuzi au orodha ya haki za msingi kabisa na ukweli tupu ambazo ndugu zetu vipenzi waislaam wanazidai na wanaamini zinaporwa na serikali au na wakristo. Hii itatupa wigo mpana zaidi ya kujadili na kusaidiana maana huenda kuna wenzetu wakawa na uelewa safi wa baadhi ya hoja.

Karibu Sheikh Makame Idd ututajie hizo kero zenu za haki, sio stori ndeefu hadi mtu ajisikie uvivu jaribu sana kufupisha mno na kuziorodhesha ili iwe rahisi kuzibaini.

Nyerere huko aliko kwa kuifanya Tanzania nchi ambayo haina DINI, bali, kila mtu anao uhuru wa kuabudu dini anayoitaka. Hii ndio kweli, na ukweli huu ndio hata Mungu aliutaka. Watu wote wawe na uhuru wa kumwabudu na kumheshimu Mungu kwa jinsia na namna yao wanayoitaka, na sio hii ya kulazimishana kama 'ilivyoashiriwa' kwenye mahakama ya kadhi. Tena, kwa wana historia, mtakumbuka kinachotokea Nigeria leo hii hakikuwepo kwenye miaka ya 1970 - mwishoni mwa miaka ya 1980! Ila baada ya nchi hii kugawanyika, hasa sehemu ya Kaskazini ilipojitenga na kuwa na utawala wa Sharia, ndipo balaa linalowatafuna hadi leo hii la Boko-haramu lilipoibuka, licha ya akina mama kuuwawa, kisa, wamefumaniwa kwenye uzinzi! Ila cha kushangaza, mwanamke peke yake ndiye anayehukumiwa kwa uzinzi? Je, wagoni wao je? Kwa maneno mafupi kabisa,nawashauri ndugu zangu waislam waache kabisa kudhani au kufikiria kuwa ili dini yao ishike hatamu ni lazima mifumo yao iwe incoporated katika taratibu za kiserikali. Hizo ndoto ni sawa na kufikiria kujenga nyumba angani au ndani ya bahari..nikimaanisha kuwa sio kwamba haiwezekani lakini gharaama yake ni kubwa mno kuliko faida yenyewe. Mtu yeyote mwenye malengo mema na Tanzania yetu ni lazima awe na ndoto za kuifanya Tanzania kuwa neutral and quite stable state, highly paralysed with regards to the religion and beliefs sensitivity. Viongozi wa type hii ndio wataofanikiwa....on the contrary, hakutakuwa kuna kitu kinachoitwa Tannzania.


Watu wote  wanaojua haki za binadamu na maisha bora ya binadamu hakuna hata siku moja unaweza fikiria kuruhusu eti mahakama za kadhi zifanye kazi Tanzania kwa kusimamiwa na dola ya nchi..Hilo haliwezekani kwani kimsingi mahakama hizo zinapingana sana na haki na msimamo ya kimataifa ya haki za binadamu..Hivyo basi,kwa taifa kulinda watu wake ni lazima ikatae na isijihusishe na masuala yeyote ya dini ili serikali ndio iwe kimbilio la mwisho kwa wanaoona hawajatendewa haki.
Waislam ndugu zanguni, ni ruksa kwenu kuendelea kulipigania hili lakini ni ukweli usiopingika kuwa hamtafanikiwa kwa Tanzania yetu ijayo..huu ndio ukweli..

Huwa nawaambia watu "watu wengi kwa kutokujua wanapoteza muda mwingi kufungua milango ambayo Mungu amefunga na ambayo haitafunguka.Kumbe,wangelijua,wangepita kwenye milango ambayo Mungu kaiacha wazi na wangefika watakako".

Siasa, inatakiwa iongoze na kuzimamia 'religion, social life and its development, military, and the political life including its career. Kimsingi, msimamo wa katiba yetu wa kutoa uhuru wa kuabudu kwa kila raia UNATOSHA, haya mengine, 'implicitly, shall non systematically derail the national focus to the way-side, which none will consciously support!

huu mjadala zaidi ni serikali na waislam pia ieleweke kama kundi jamii pia linalostahili haki na kuthaminiwa kama makundi jamii mengine, mfano kundi jamii moja ndilo linaonekana linahaki zaidi la hamna dini, au serikali haina dini, hii sio haki kwa sababu kutokuwa na dini kunakundi pia halina dini, ndio lipewe haki zote?. minafikiri kwa sasa serikali inaona kama utani ila ipo siku historia itakuja kuhukumu na hapo majuto yatakuwa mjukuu. Sisi Maaskofu na Viongozi wa makanisa na mashirika wanachama wa Jumuiya ya Kikristo Tanzania (CCT) tumetafakari kwa Roho ya Kiutume na Kinabii kwa nchi yetu juu ya Uanzishwaji wa Mahakama ya Kadhi nchini na Tanzania kujiunga katika ushirikiano na Jumuiya ya Kimataifa ya Kiislamu (OIC).

Tunazingatia na kutambua kwa dhati na fahari kubwa kuwa nchi yetu haina dini na kwamba jambo hili limekuwa ni mojawapo ya tunu na misingi imara ya umoja na utaifa na amani ya nchi hii. Tumeipongeza Serikali yetu mara nyingi kwa kuingiza katika Katiba ya Jamhuri ya Muungano wa Tanzania Ibara ya 19 (2) kama ifuatavyo:- Kazi ya kutangaza dini , kufanya ibada na kueneza dini itakuwa ni huru na jambo la hiari ya mtu binafsi, na shughuli na uendeshaji wa jumuiya za dini zitakuwa nje ya shughuli za mamlaka ya nchi. [Sheria ya Mabadiliko ya Kumi na Nne katika Katiba ya Jamhuri ya Muungano wa Tanzania. Na ya 2005]. Ibara hii imekuwa ni ya muhimu kwa ajili ya kusimamia na kuhakikisha kwamba mambo ya dini yanatenganishwa kabisa na shughuli za uendeshaji wa nchi yetu.

Katiba ya Jamhuri ya Muungano wa Tanzania ambayo ndiyo sheria mama ya sheria nyingine zote, imeendelea kuzingatia umuhimu huu. Hifadhi ya haki zilizotajwa katika ibara hii itakuwa chini ya taratibu zilizowekwa na sheria ambazo ni muhimu katika jamii na umoja wa kitaifa. Haya yamewekwa wazi katika Ibara ndogo ya (3) katika Ibara ya 19 [Sheria ya Mabadiliko ya Kumi na Nne Katika Katiba ya Jamhuri ya Muungano wa Tanzania . Na. 1 ya 2005]

Sheria ya Vyama vya siasa [Sura ya 258 R.E 2002] imetii na kuheshimu tuliyoyataja na kuyanukuu hapo juu katika kifungu cha 9 (2) (a) (i) ambacho kinasema; Without prejudice to subsection (i) of this section, no political party shall qualify for provisional registration if by its constitution or policy (a) it aims to advocate or further the interests of – (i) any religious belief or group. Maana yake (tafsiri ni yetu) ni kwamba chama chochote cha siasa hakitakubaliwa usajili wa muda endapo kwa kufuatana na katiba au sera ya chama chicho kinalenga kutetea au kuendeleza maslahi ya imani au kikundi chochote cha kidini.

Siku za hivi karibuni Bunge la Tanzania na vyombo vingine vya serikali vimekuwa vikijadili juu ya uwezekano wa kuanzishwa kwa Mahakama ya Kadhi na nchi kujiunga katika ushirikiano wa OIC. Maswala haya yanapojadiliwa inaashiria uwezekano wa kukubalika kwa mambo haya mawili. Kukubalika kwake ni kwenda kinyume na vifungu vya Katiba na sheria tulizotaja au kunukuu hapo juu. Si hivyo tu, bali pia ni kuruhusu kubomoka na kuvunjika kwa amani ya nchi yetu kwa sababu yanagusa hisia na itikadi za Watanzania wote.

Tunatambua kuwa vyama vya siasa katika kueleza sera na ilani zao vinajitahidi kuvutia wapiga kura wengi ili viweze kupigiwa kura ili kuchukua au kuendelea kushika uongozi wa nchi. Lakini kamwe na ni hatari isiwe ni ili mradi kushika uongozi wa nchi hata kama ni kwa gharama ya kuvunjika kwa umoja wa kitaifa na amani ya nchi hii! Hili ni jambo tusilolikubali kwa vyovyote vile kwa Chama chochote cha kisiasa kitakachokubali mambo haya mawili. Hata kama uhusiano wetu na chama hicho ni mzuri kwa sasa itabidi tufikirie upya uhusiano huu! Tunatoa tahadahari kwa Chama Cha Mapinduzi (CCM) na Serikali yake kuacha mara moja kuruhusu majadala na kukubalika kwa mambo haya.
Msimamo wetu kuhusu mambo haya mawili ni kuyakataa; na mamlaka yoyote ya nchi kuendelea kukaribisha mjadala huu ili hatimaye yakubalike ni kupoteza muda wa wenye dhamana ya mamlaka ya nchi hii na raslimali za nchi hii. Tuna uhakika wa yaliyomo katika nyaraka anzilishi za taasisi hizo na ni hatari kabisa endapo yakikubalika nchi itaingizwa katika migogoro itakayoua maridhiano, mshikamano, amani, utangamano na umoja wa kitaifa. Kama ilivyokuwa wakati wote tangu kupata Uhuru wa nchi hii hadi sasa mambo ya imani zao bila ya kuingiza mamlaka za nchi katika gharama na kutumia rasilimali na muda ambavyo ni muhimu kwa maendeleo ya /na ustawi wa familia, umma na Taifa kwa ujumla.

Tunaendelea kuweka mkazo kwamba yale mambo yote ambayo yamekuwa ni tunu kwa Taifa hili tangu kuasisiwa kwake yasitikiswe wala kuhojiwa kwa makusudi ya kuyaondosha au kudhoofisha umuhimu wake.

Kwa kuzingatia wajibu wetu wa Kinabii na Ki-utume, Jumuiya ya Kikristo Tanzania inatoa wito kwa Bunge letu lisikubali kamwe kuanzishwa kwa Mahakama ya Kadhi nchini kwa kupitia mchakato wa utendaji wa mamlaka ya nchi, wala kuridhia uanachama wa Tanzania katika OIC. Tanzania yenye amani imetokana na ni tunda la uhuru wa dini, itikadi, makabila, rangi na jinsia zote.
