[wanabidii] ICC ignores CJ's 'poison letter'

Why file porojo the same day it is fronted by those who wanted to fix the March 4th elections? The judges have seen the machinations by the prosecution and threw it back on her face. That case will fail because of the way they have done some things. The letter together with Mutunga's February 20 statement on judge's security and elections were transmitted to the court on the same day- February 20. The registry of the court which filed the two documents claims to have received them from the prosecution.It had said the prosecution had indicated that the documents should be brought to the attention of the trial chamber. The registry had also instructed its security section to make an assessment and their impact on the security situation in Kenya. The defence of deputy President William Ruto however objected to the manner in which the document was filed there. "The Chamber agrees with the Defense as to the unusual nature of the filing. The documents annexed to the Registry's filing were received in the first instance by the Prosecution and forwarded to the Registry. To the extent that the Prosecution considered that they should be brought to the attention of the Chamber, the proper procedure would have been for the Prosecution to file the documents directly together with any appropriate request for relief," the judges ruled. Mutunga's letter was written by a group calling itself Mungiki Veterans  Group/Kenya Sovereignty Defence Squad. Ruto's lawyers complained that registry appeared to act for the prosecution by filing the documents to the attention of the judges. They also said that the letter was a "concoction" aimed at prejudicing former President Mwai Kibaki, President Uhuru and other accused. Ruto said due to heavy political overtones the cases have in Kenya the registry should act more careful. "The Defence requests the Registry to keep the Chamber and the parties informed of the follow up investigations that are being carried out by the Security and Safety Section of the Court," Ruto's lawyers said. The judges ruled that on top of improper procedure, no proper basis was made on why the two documents were filed.
