Assume for a moment we had an open and transparent election free from rigging of any kind and it turns out the winner had 1 vote more than he should have due to an honest clerical error. As it turns out, that's the one vote that puts him over the 50% + 1 constitutional threshold to be sworn as president. Assume further a losing candidate challenges the declaration that this person is the one who won. Do you think any judge will buy the argument that this was merely a clerical error therefore the court should not nullify the declaration of the winner in that case?

Please do not answer unless you're giving an honest answer.

That's what we are faced with here and that's, did these "errors"--if one can call them that; we call it deliberate manipulation--anyway however you call them, are they of a nature that would reasonably be concluded they altered the results of the poll?

The answer is obviously an unequivocal YES! and the Supreme Court will accordingly so rule today in the Raila case.

Lawyer Katwa Kigen representing Deputy-president elect William Ruto said the elections were conducted fairly.

"The elections were conducted by humans and humans commit errors, mistakes and oversight but in this case they are insignificant and do not suggest malice or collusion," he said.

Now,if you were a judge,what kind of ruling do you make here in connection to WHO SHOULD BE THE BENEFICIALLY OF THE ERRORS APPARENT AND ADMITTED!
