In a milestone development the East African Court of Justice has declared that constructing a bitumen road across the world famous Serengeti National Park is unlawful. The Judges have restrained the Tanzanian Government from constructing the road. The judgement in essence confirms that the prestigious Serengeti ecosystem is an invaluable world heritage site and that deserves optimal protection and restraint from high impact development that can interfere with the functions of the ecosystem to humankind.--
ANAW fully respects Tanzania's sovereignty and its need for national development. However, by taking up this matter, ANAW was in actual fact protect a resource that would be of future benefit no only to Tanzanians or East Africans but also the entire humanity.

At the request of the Tanzanian Government Germany has started a feasibility study for an alternative southern road around the Serengeti ecosystem. In 2009 the Government of Tanzania announced its intention to build a road connecting Arusha to Musoma by crossing the Serengeti National Park. This would have bisected the path that the huge wildebeest herds take in their annual migration between Kenya and Tanzania, from northern watering holes to their southern grazing pastures. After intensive discussions and inputs from Development Partners and NGOs the Government of Tanzania committed itself vis-à-vis UNESCO in 2011 that the project would avoid a tarmac road inside Serengeti National Park.
To support the Tanzanian Government in their efforts to develop the remote areas of North-Western Tanzania while at the same time protecting the Serengeti Nationalpark the German government committed itself in 2012 to evaluate possible alternatives to a "northern Serengeti Highway". The Feasibility Study that is currently been implemented by KfW will look into different alternative routes around Lake Eyasi Route. The results of the study are expected to be ready at the end of 2015.
Germany has been a major partner in conserving wildlife in Tanzania for many decades. Currently Germany is implementing the Program "Protection and Sustainable Management of Natural Resources in Serengeti and Selous" with 31,5 Mio. EUR.

Mr Matata said that if the orders sought by the Africa Network for Animal Welfare (ANAW) are granted, it will frustrate the tourism sector in the entire East African region, because the road is meant to facilitate the movement of tourists.
ANAW filed a law suit in 2010 asking the regional court to declare the proposed highway unlawful since the road threatened to disrupt the annual migration of wildebeest between the Serengeti and the Maasai Mara.
Hearing
During the hearing, ANAW through its lawyer Saitabao Mbalelo, stated that the construction of the superhighway across the Serengeti is unlawful and infringes articles 5, 8, 112 and 114 of the Treaty for the establishment of the East African Community."The construction of the road through the park would be hazardous to the environment generally and animals in particular," said Mr Saitabao, adding that the road will be a potential threat to wildlife as it will interrupt their movement and migration.
"The five km road is gravel level and is not yet open for public use but the Tanzanian government intends to free it."
The Court is yet to deliver its ruling.
