her support excitement for Chinese root in Kenya, her two times trip to Kenya this year alone, and her expectation for swearing in of Uhuru on 26th March, 2013 before court rullingsspeeks volume. Whatever her mission to Kenya, it is a wake up call to all Kenyans, friends and sympathizers of Kenya that things are not rosy.
 
 
 
It is really sad that she is able to talk this way but, nice trial Jendayi what she failed to undestand is Kenyas success story is Americas success and that, Kenya is bigger than Special Interest Community.......!!!!

How are you in the midlands of Carlifonia? My brother, the core reason we have given ourselves devolution is the fact that we accpeted that Kenya is too big, even for the OPresident to satisfactoruily adminioster and economically develop at the same pace... for this reason, we have created counties to help, individually, develope so as to reach that10% sustainable mark.

The reason i bring this to you and to many is so as to understand the roles each county, individually and severally is going to play to bring Kenya to a middle income status! I therefore need not emphasize the need for Kenyans to solidly stand with each other to help achieve this. MR Ki-bet, We Kenyans need each other individually and severally more than ever to be able to now "DO IT" .

Mr Kibet, You are and surely belong to the larger house and gene of the Nilotic group!

US issues travel warning to citizens over petition

Nairobi, Kenya: The US government has issued a travel advisory to its citizens over the presidential election petitions filed against Uhuru Kenyatta.
In the advisory, the Barak Obama led administration tells its citizens to avoid gatherings and demonstrations as the ruling on the petitions is likely to be issued on Easter weekend.
"The decision may be announced during the Easter holiday weekend, a time when many people go out of town. There could be a strong public reaction to the announcement; therefore, the U.S. Embassy strongly urges all U.S. citizens to avoid gatherings, demonstrations, downtown business areas, slums, and large crowds of any kind," the advisory stated.
The US warned that gatherings intended to be peaceful could turn violent with little or no warning.
"U.S. citizens are advised to be cautious and monitor local media for the latest information on demonstrations and traffic disruptions, particularly those who plan to spend the holiday away from home."
The advisory was issued on Tuesday as the re-tallying of votes ordered by the Supreme Court that is hearing the petitions, started.
The Supreme Court led by Chief Justice Willy Mutunga is expected to deliver a ruling on the presidential petitions by Saturday, March 30.
There are three petitions filed against Kenyatta, one by Prime Minister Raila Odinga who is seeking several declarations among them those that could, if granted, force fresh presidential elections through invalidation of the recent poll.
 
 
 

Presidential poll re-tally underway

NAIROBI, KENYA: The re-tallying of presidential votes from 22 polling stations as directed by the Supreme Court has commenced in Nairobi.
The exercise will also involve auditing of all the Forms 36 used by the Independent Electoral and Boundaries Commission (IEBC) in aggregating tallies from Forms 34.
On Monday, the court read out 22 polling stations in which re-tallying of presidential votes shall be conducted using the Forms 34 and 36.
Judiciary officials are conducting the exercise, but representatives from Independent electoral Commission (IEBC) and agents of the petitioners in the case are present at the Kenyatta International Conference Centre (KICC) venue.
The petitioners in the three consolidated petitions are required to jointly appoint ten agents as observers in the scrutiny exercise while all the four respondents shall also jointly appoint a similar number. Before commencing the re-tally, the agents took an oath of secrecy administered by the Registrar.
The swearing happened behind closed doors at the KICC early Tuesday morning. There is a heavy security presence at the KICC and journalists have also been barred from accessing the tallying venue.
The re-tallying was ordered by the Supreme Court on Monday to establish if votes cast exceeded the number of registered voters in those areas as claimed by Prime Minister Raila Odinga in the petition at the Supreme Court
"That scrutiny shall aim at establishing the number of registered voters, the votes cast and the votes rejected," the court said in a directive read by Justice Smokin Wanjala.
Further the court shall scrutinise all the Forms 36 used by the Independent Electoral and Boundaries Commission (IEBC) in aggregating tallies from Forms 34. This would help in establishing the accuracy or inaccuracy of the process and comparing the number of registered voters on Form 34 and those on principal register.
The results of the scrutiny exercise will be filed at the court registry.

Controversy is simmering within political circles over President-elect Uhuru Kenyatta and the deputy president-elect William Ruto's increasingly active government engagements despite the Supreme Court petition challenging the presidential election results.
Also on the spotlight are the actions of outgoing President Kibaki since the March 4 General Election, which critics say paint the picture of a man eager to hand over power even before the Supreme Court's dispenses with Prime Minister Raila Odinga's petition.
Of particular concern to critics, especially the top leadership of Cord, are the actions of Mr Kenyatta and Mr Ruto over the last one week, and the symbolism of last Friday's ceremony which saw the Kenya Defence Forces officially bid President Kibaki farewell.
Even though the Department of Defence was quick to down play the ceremony at the Moi Air Base in Nairobi's Eastleigh neighbourhood, saying President Kibaki still remains in office until a new president is sworn in, the Cord leadership maintained that the Head of State ought to have awaited the Supreme Court's verdict before undertaking the event.
"What happens if the Supreme Court rules that there is a fresh election and the incumbent is forced to remain in office for another 60 days? His powers as the Commander-in-Chief would have been greatly diminished in the eyes of the military, which has already bid him goodbye," said Lands Minister James Orengo.
"The over-enthusiasm with which the (Assumption of the Office of the President) Act is being implemented amounts to undermining the authority of the Supreme Court because it is creating an impression that there is no challenge to the presidential election; that it is a fait accompli," he protested.
"The Assumption of the Office of the President Act remains suspended if there is a petition challenging the election of the president," said another top Cord member who said he was under instructions not to make public comments on the election controversy until the Supreme Court determines the petition.
Besides the military ceremony, the Cord team is alarmed at what it sees as a silent transfer of power to Mr Kenyatta and Mr Ruto.
The Cord leaders have taken great exception to the now routine security briefings to the President-elect and his deputy by top security chiefs led by KDF Chief Julius Karangi, Inspector General of Police David Kimaiyo and the Director General of the National Intelligence Service Michael Gichangi.
"There is a danger of compromising state security when the top security chiefs give classified intelligence security reports to a person who may end up not being the president in the event that the petition succeeds," says the Lands minister.
The Cord team also accuses Mr Kenyatta and Mr Ruto of issuing policy statements and decrees when they have not been sworn in.
They cite Mr Kenyatta's directive this week that the Mombasa port will not be privatised and that instead, his government will focus on ensuring that it operates efficiently for the benefit of all Kenyans. They question on whose authority Mr Ruto made a policy statement to the effect that the government has set aside Sh2.7 billion to import subsidised fertilisers.
Mr Ruto said the 45,000 metric tonnes will in the next one week be delivered to farmers across the country as the planting season sets in.
They also cite last Wednesday night meeting of the National Security Advisory Committee chaired by Head of Civil Service Francis Kimemia to discuss security threats and which imposed restrictions on political gatherings and warned Mr Odinga against proceeding with his planned countrywide "thank you" rallies.
There was also an earlier order for ministers who won elective seats to resign before being sworn in. Mr Odinga subsequently told ministers to ignore the directive and remain in office until a new government was established.
But even as Mr Odinga was ordering ministers to stay put, all ministerial functions including the approval of petty cash has been quietly transferred to permanent secretaries to the total exclusion of ministers and junior ministry staff.
Mr Odinga revisited the subject at a funeral in Siaya county yesterday, cautioning public servants especially Permanent Secretaries against taking "political decisions" in the presumption that they could oversee the transition period.
He maintained that the coalition government remains in office until the fourth President is sworn, clarifying that the lifespan of the coalition comes to an end when the new government legitimately assumes office.
"The coalition government is still in power because the President, the Prime Minister, and the Vice President will remain in office until the next government takes oath of office" he said.
Mr Kenyatta had earlier travelled to the Coast in an Airforce plane where he was followed by Mr Ruto who travelled in a Police helicopter.
"He should desist from using State resources and not behave as if he is already president. What he is doing right now is premature," said Mr Odinga at the Bomas of Kenya where he met leaders elected under the Cord ticket in Nairobi.
Sunday Nation has however learnt that Mr Odinga and Vice-President Kalonzo Musyoka still enjoy the privileges of their offices.
Mr Musyoka spent the better part of last week in his Jogoo House office attending to government matters, we learnt. "The VP still has unhindered access to the president, he is still his Vice president," said his spokesman, Kaplich Barsito.
"To the best of my knowledge, their offices are still open. Their hotlines are still open and their security detail still in place and even their motorcade," said the senior Cord official who declined to be named.
The government has in the past defended the security briefings to Mr Kenyatta and Mr Ruto saying they are provided for under the Assumption of Office of the President Act.
Government spokesman Muthui Kariuki cited section 10 of the Act which states that the President-elect shall receive security briefings from the respective national security organs.
It also binds public officers into furnishing the president elect with any information he may seek, failure to which he will be liable to a fine of up to Sh1 million fine.

Monday March 25, 2013 - News just in indicates that Orange Democratic Movement (ODM) mole and blogger Robert Alai Onyango has been summoned by detectives from CID, for malicious tweets on his twitter account.

Alai was summoned on Monday morning over a tweet he had written implying that Judge Isaac Lenaola, IEBC CEO Oswago, Head of Civil Service Francis Kimemia and IEBC chairman Issack Hassan met on Saturday to influence the outcome of the Supreme Court.

Alai, who is a sympathiser of Prime Minister Raila Odinga, is famously known for spewing malicious and hatred information through his Twitter and Facebook accounts.

Detectives said they will carry investigations and Alai will be arraigned in court once investigations are over.

Saturday March 23, 2013 - The Coalition for Reforms and Democracy (CORD) is now accusing the Supreme Court registry and the media of working with the Jubilee coalition to retrieve replied affidavits from the court registry and amending them.

In a statement leaked to the press on Saturday, CORD alliance which is associated with Prime Minister Raila Odinga and Vice President Kalonzo Musyoka, said some top officials from the Supreme Court have been spotted in secret locations with members of the Jubilee Alliance, a thing which they said may affect the Supreme Court's verdict expected late next week.

At the same time, CORD also accused the Nation Media Group (NMG) and Standard Group of swaying the public opinion against the CORD petition after they highlighted IEBC's response to CORD petition.

They said journalists from the two major media houses are swaying the public opinion by writing articles that favour Jubilee Alliance in the petition.

CORD alliance last week filed a petition at the Supreme Court challenging the declaration of Uhuru Kenyatta as the fourth President of Kenya by the IEBC on March 9th.

The ruling of the petition is expected not later than Friday next week.

Friday, the 22nd of March 2013 - The Independent Electoral and Boundaries Commission (IEBC) has called on the Supreme Court to dismiss the Presidential election petition filed by CORD's Raila Odinga last Saturday.

The IEBC made the comments in reply to CORD's petition which lists the commission, President-elect Uhuru Kenyatta and his deputy William Ruto as respondents.

The IEBC further claimed that the Supreme Court has no power to nullify the results of the Presidential election as released by the IEBC;

"There is no lawful basis whatsoever advanced by the Petitioner that would warrant either the setting aside of the results announced or the electoral process as a whole. The orders sought constitute a subversion of constitutional order," reads the IEBC's reply.

The IEBC further claimed that the use of Electronic Voter Identification Devices (EVID) did not affect the integrity of the results;

"Presiding Officers experienced challenges in the use of Electronic Voter Identification Devices (EVID) in some polling stations, which subsequently continued to do with the use of manual registers which themselves contain biometric details of voters. The integrity of the process was neither violated, vitiated breached, compromised or rendered ineffective."

"Presiding officers did not breach Regulation 82 of the General Election as alleged by the petitioner since they indeed tried to transmit the said provisional results, but due to technological challenges did not succeed."

The IEBC's reply also reveals that it held a meeting with party representatives to inform them of the failure of the electronic transfer system;

"That after the RTS experienced operational challenges, the Commission at the National Tallying Centre (at Bomas of Kenya) held a consultative meeting with chief political party agents and an agreement was reached on the mode of verification of presidential election results brought in by Returning Officers."
