[wanabidii] MCHANGO WA MAHAKAMA UJENZI WA TAIFA: CHANGAMOTO WANAZOKABILIANA NAZO

Baada ya makala yangu katika gazeti la Tanzania Daima toleo na 4463 ya tarehe 22 February 2017 yenye kichwa "Upi mchango wa mahakama katika uchumi" nilipigiwa simu zilizosifu makala hiyo hata kutoka kwa mahakimu.
Mmoja kati ya mahakimu hao aliniuliza kama ninaelewa changamoto wanazokabiliana nazo wanasheria/mahakimu. Nikamwambia moja. Akaridhika. Nikaamua kuandiika makala hii kujadili zaidi changamoto zinazowakabili watendaji wa idara hii ili tunapowataka kubadilika katika tunayowalaumu tuwe tunazingatia pia wajibu wetu katika kuwasaidia kubadilika.

Kabla ya kuzama kwa changamoto za mahakimu ningependa kujielekeza katika malalamiko ya wafanyakazi wa Tanzania kwa ujumla. Sasa watanzania wote (wengi) tunajua kuwa walimu wanaidai serikali madeni yanayozidi Shilingi trilioni moja. Fedha hizo zinatokana na malimbikizo ya nyongeza za mishahara baada ya kupanda vyeo; Fedha za uhamisho na marupurupu mengine ambayo serikali huchelewa kuwalipa walimu kwa uzembe tu na mipango mibaya ya serikali. (atakayebisha nitamfafanulia). Kinachotufanya tujue madeni haya ni wingi wa walimu. Mabwanashamba wanadai. Mabwanamifugo wanadai. Makarani, madaktari, manesi na wengine wote wanadai. Tatizo la madai yao kutojulikana ni uchache wao. Mabwanashamba wakitishia kugoma Simbachawene wala hana muda wa kukutana nao. Nani atasikia hata wakigoma? Manesi wakitishia madhara ya mgomo wao unaonekana masaa mawili toka walipogoma. Walimu pia. Ndiyo maana serikali ina tahadhali na wafanyakazi wa namna hiyo. Wanyonge wapi? Shauri yao.

Siku moja niliandaa warsha (workshop) ambayo nilitaka matokeo yake yalete impact. Kwa hiyo kulikuwa na garama. Washiriki nikawaelekeza watafute nyumba za kulala wageni wanazoona ni garama ndogo kwao na mkutano utafanyika katika hoteli Fulani ambayo ina garama kubwa. Mshiriki mmoja akachukua chumba kwenye hoteli hiyo ya garama kubwa. Nilipomuuliza atamuduje akaniambia hivi: "Mimi ni mwanasheria. Maeneo haya nimesimamia kesi ambazo matokeo ya kesi hayakuwa mazuri kwa watu Fulani. Nikilala huko ulikoelekeza usishangae kukuta nimevunjwa mguu au hata kuuwawa. Kwa hiyo naomba warsha yako igarimie usalama wangu". Nikainama; nikainuka. Nikamhakikishia kugharimia chumba na kumpa posho yake kama waliolala nje ya mahali pale.
Hii ilinifanya niyachunguze mazingira ya wanasheria wetu na wakiwemo mahakimu. Nikaelewa mengi.
Ukiuliza nani yuko hatarini kati ya jaji anayehukumu kesi za mauaji na hakimu anayezipitia kwanza huku mahakama yake haina mandate ya kuzisikiliza, ni rahisi kumtaja jaji anayehukumu mtu kunyongwa kuwa ndiye aliye hatarini. SIO. Huyu hakimu anayeletewa kesi ya mshukiwa wa mauaji. Akaambiwa "Fulani anatuhumiwa kumuua Fulani. Hana dhamana. Huruhusiwi kusikiliza kesi hii kwa hiyo umuweke ndani na uahirishe kesi" huyo yuko hatarini zaidi. Ndugu wa marehemu wanadhani atakula rushwa kwa hiyo wanamfuatilia. Ndugu wa mtuhumiwa wanaona 'huyu ndiye kamfunga baba yetu'

Bangi inatumiwa vijijini sana kuliko mijini. Na mijini ni maeneo yaliyo pembezoni. Watuhumiwa ni wahuni wanaorandaranda mitaani. Unapomkamata unamletea Hakimu aamue. Mtu kama huyo hana mdhamana. Unapomfunga kiongozi wa genge la vijana wanamna hiyo 10 maana yake tisa wanakuona adui yao namba moja.
Hebu tuyaangalie mazingira wanayoishi na kufanyia kazi mahakimu hawa. Usafiri wao ni Pikipiki. Wamekopeshwa na serikali. Pikipiki hizo ni usafiri wa kutoka kituo "A" kwenda kituo "D" katika kile kinachoitwa mahakama zinazohama (Mobile courts). Atapanda pikipiki hiyo kurudi kituoni kwake akipitia point "B" na "C" (pori Fulani na msitu mene Fulani). Hawa vijana tisa ambao kiongozi wao amemuacha lockup wanamtazamaje? Kwa nini wasimsindikize kupitia pori lile? Kwa nini wasimsubiri huko na kuhojiana naye huko msituni kuhusiana na mwenzao aliyemuacha lupango? Hawa wanaweza kumalizanaje huko?
Hakimu huyu anayefanya katika mazingira haya anaishi wapi? Anapanga nyumba moja pamoja na mwalimu na mfanya biashara wa samaki. Mshahara wake unamsaidia kupanga humo. Huyo muuza samaki anauza samaki tu au na unga? Hakimu huyo asipokuwa mwangalifu jirani hao wanaweza kutumwa kwake na wale walioachwa lupango.
Ninajua idara ya mahakama inapanga. Inapoandaa marupurupu inatumia busara. Ni lazima katika kupanga inaelewa kuwa jamii inainyooshea vidole kuhusu rushwa. Ningesaidia idara kupanga ningeielekeza kuangalia maslahi ya mahakimu kabla ya mambo mengine. Niliwahi kutembelea taasisi fulani uingereza (Naomba nisiitaje). Nilikuta mle tarishi anatembelea gari binafsi. Maafisa wanatumia magari ya jumla. Mimi hupenda sana kufuatilia mambo madogomadogo kama hayo. Nilipouliza kwa nini wakalishangaa swali. Maana walisema 'tunakuona kama kiongozi mzuri'. Mmoja akanijibu kwa swali. Kati ya afisa na tarishi nani ana shughuli nyingi za nje ya ofisi. Nikacheka na mjadala ukaishia hapo. Nilielewa kuwa ofisi hiyo inawapa watarishi usafiri binanfsi ili wakimbizane na barua na vifurushi na mengine kama hayo. Maafisa wanakaa ofisini na kwa nadra wanakuwa nje, usafiri binafsi kwao hauna haja.
Sisi kwetu sio. Magari wanapewa majaji. Na nyumba bora zenye ulinzi pia. Inahitaji wapangaji kuangalia sana usalama wa mahakimu wetu. Huenda mahakimu wa nje hasa vijijini wanahitaji kupewa magari ya kutembelea ya ofisi au mkopo. Wanahitaji kupangiwa nyumba wala sio kuwaacha wapange wenyewe. Watapanga za bei ndogo ambazo si salama. Usalama wao unahitaji kuonekana unaangaliwa katika marupurupu yao badala ya kuonekana tunaangalia madaraka na heshima za ukubwa.
Kama hakimu akiniambia "najaribu kukusanya fedha za kulinda usalama wangu ndiyo maana niliomba rushwa"; sitakurupuka kumkatalia.
