Ruto Opposes Move To Have Trials Deferred, Prefers Excusal

Deputy President William Ruto has broken his silence on the weekend resolution by the African Union asking President Uhuru Kenyatta and himself to suspend co-operation with the International Criminal Court, until an AU request to the United Nations security council to have their cases deferred, is processed. Earlier Tuesday, Ruto addressed a press conference at the Hague, Netherlands where his trial is currently ongoing, during which he said would continue attending trial until such a time that the United Nations security council rules on the AU application. Even as the question as to whether President Kenyatta will follow suit remains puzzling, Ruto once again asked the court to respect the constitutional obligations of the two Kenyan leaders. Ruto wants to be excused from physically attending trial until a decision by the UN security council is arrived at.

I want case to go on, William Ruto says but seeks to skip sessions

Deputy President William Ruto appeared to sing a different tune from that of the African Union that has expressly advised President Uhuru Kenyatta not to attend his trial for crimes against humanity at the International Criminal Court ICC. In a press briefing in The Hague, the deputy President said he prefers to waive his right to attend the trial as opposed to a deferral sought by the AU. Ruto say he is for a quick, logical conclusion to the case.

Deputy President William Ruto would like his trial for crimes against humanity to continue at the Hague if he is allowed to be away some of the time.
Mr Ruto said he supports efforts to defer the cases, but would rather proceed with it if he is excused from attending all hearings.
"It would not be necessary for us to pursue the issues of deferral if we can get the issues of excusal sorted out," he said. "Indeed, that is our preference because we are people who believe in the rule of law and we want to go ahead with accountability. We do not want to short-change the system."
He spoke at a press conference in The Hague as the Ministry of Foreign Affairs and the African Union worked in tandem to finalise a petition to the UN Security Council asking for the Kenyan cases to be postponed.
"The paper work is being processed," State House spokesman Manoah Esipisu said by phone.
The move by Kenya to appeal to the UN Security Council arises from the resolutions of the weekend Special AU Summit in Addis Ethiopia, which declared that the cases against President Kenyatta and his deputy should be deferred.
The meeting mandated Kenya to write to the UN Security Council, with all member states appending their signatures, seeking for the deferral of the cases under Article 16 of the Rome Statute which establishes the ICC.
They also agreed on a delegation of five presidents, drawn from each of the regions in the continent, who will be accompanied by AU chairman Haillemariam Dessalegn and AU Commission chairperson Nkosazana Dlamini-Zuma to fly to the UN Security Council to push for the deferral of the cases.
Should the 15-member UN Security Council, five of who are permanent, turn down their request, the AU will write to the ICC seeking for the deferral of the cases.
And if what they have termed as unfair treatment of the Kenya cases continues, they will convene another extraordinary AU Summit at the end of next month to announce far reaching measures.
ICC FRAMEWORK
Three of the five veto-wielding members of the UN Security Council — France, United States and United Kingdom — voted against the deferral request the last time Kenya filed an application. This week, France President Francois Hollande, during a visit to South Africa gave an indication that his country may not change its position when he said the problem should be sorted within the ICC framework.
"If the African states have a problem, they should look at ways of solving it within the ICC framework. You should not accept impunity in this age," he said.
A spokesman of the British High Commission in Nairobi, Mr John Bradshaw, had also said that the decision regarding deferral would be taken by the full UN Security Council session.
"We are studying the decision of the African Union and it will be for the full UN Security Council to make the decision," he said.
In New York, senior legal advisors to UN Secretary-General Ban Ki-Moon are "carefully studying" the AU's recent statements regarding the ICC, a UN spokesman said on Monday.
UNPRECEDENTED
There was no explicit UN response, however, to the AU's call for a one-year deferral of the cases against President Kenyatta and his deputy, Mr Ruto. (READ: Uhuru will not appear at the ICC until our demands are met: AU)
Article 16 was intended for use in exceptional circumstances and the Security Council has never deferred an ICC investigation or prosecution.
UN spokesman Martin Nesirky said the AU meeting "was obviously a very important one". And he indicated that Mr Ban and other top UN officials have been holding telephone talks with African leaders in recent days.
The spokesman also reiterated Mr Ban's supportive position regarding the ICC.
"The secretary-general believes that the International Criminal Court plays a central role in the efforts of the international community to ensure accountability and to end impunity for the most serious crimes of international concern," he said.
Kenyan Ambassador to the UN, Mr Macharia Kamau said on Monday that he had no comment in response to a Nation query regarding Kenya's lobbying of the UN Security Council.
Some analysts are meanwhile responding sceptically to a report in a British newspaper that Western diplomats were moving to meet the request for a deferral. (READ: Western envoys set stage for UN talks on Uhuru)
"I do not think it's accurate," said Brigitte Suhr, an official with a non-governmental organisation that does advocacy work on behalf of the International Criminal Court. "I believe it is making leaps from where the situation stands now."
Mr Kenyatta's case is expected to start on November 12 and it is still not clear whether he will be attending court.
However, the AU has given the UN and the ICC until that day to take a position on possible deferral of the cases.
But on Tuesday, Mr Ruto said: "Our preference is that we want these cases to proceed to their logical conclusion because we are confident that finally we shall be discharged of these allegations and we would be proven to be innocent because indeed we are innocent."

Ali mjanja? Others are not? Ruto is clearly saying, the problem is suppose to be solved,but the cabal around Uhuru are selfseekers. Uhuru does not have to fear appearing at the court for he was there. If he refuses to then he would be a fugitive.
Ruto should soldier on. They are accused and accused cannot give altimatum to a court. Ruto is right and he had differred before with the State House position before on defferal.

"JUSTICE DELAYED IS JUSTICE DENIED." Mr Ruto understands that is not just his justice but the justice of the victims that is on the line. The president should follow suit and stop running to regional clowns like Mugabe, Bashir and Museveni to save his skin.
 
 
I feel sorry for Ruto. Really I do. He has prepared himself to argue his case in court and clear his name but his boss keeps throwing the spanner in the works. At the start of trial there was that stupid letter by a UN ambassador which forced Ruto's lawyer to tell the court that Ruto was not party to it and was not consulted and does not support it. Now his boss is at it again forcing Ruto to publicly state that he wants the case to proceed. This is tough for Ruto but he must remember he is charged as an individual and must look out for himself. I spoke with afriend in USA this morning and the story he gave me about the plan shook me more than Ruto was.
All the same I wonder why Ruto thought Uhuru will be nice to him.

The last 5 days have have seen Kenya taken through some ridicule in the eyes of the International community. The Kenyan Head of State put the Country into a near insane gear, where the whole of Africa was rallied to reject something that Kenyan Parliament brought on itself. It was like the whole Country had been consumed on dementia making it forget a decision it made barely three years ago. The cacophony that was made by the Leader of the Country, the President himself, would have been enough to convince an unwise man to make hasty decisions.

First, it started by a strange decision by Parliament to decide to rally its members to pass a resolution to withdraw Kenya from ICC. Then there was the application made to UN for a deferral; even though the UN has said it almost 1000 times that they did not have much say on the ICC. This also despite the fact that the president of ICC came to Kenya and discussed how they operate. The man had been interviewed with the local media and made it clear that if Kenya wanted to talk they needed to write directly to ICC.

Despite all this information President's advisers still told him to avoid writing to ICC but instead follow these other avenues which were not going to bear any fruits. It was a very stressful week for Kenyans, mind boggling to say the least. A country which had chosen through its own Parliament to go to ICC, was now putting the entire world through some insanity hoping to pull out of it .

As this went on, however, there were some people and certain Kenyans who stayed on top of things and their professions. One such person is Khan and the battery of Lawyers in Ruto's defense at ICC. Team Ruto quickly saw through the smokescreen on these shenanigans which the president was taking Kenyans through. Information reaching my desk Courtesy of Arap Mole is that Ruto was being set up for a Warrant of Arrest. Sipai says that a conducive environment was being set to force Ruto to fall a victim which would find him facing an arrest by the Court.

This is how it was to work. Ruto's Boss was to rally AU to have them issue a Statement on a pull out. The Union also was to advise Ruto to stay away from the Court. Had Ruto listened to them then it could have been over. Ruto's Lawyers sat down, brainstormed, and arrived at a conclusion that Ruto could have put himself into problems had he failed to attend the Court. Unbeknownst to them was that a plan had been hatched to convince Ruto to stay away from the court. Had he done this then the warrant of Arrest was to be issued sealing Ruto's fate. Then in November Kamwana could have made an about turn to attend the Court, having a Vice president who was already locked at the Hague.

Sipai informs me that the plan was working well till a friendly person advised Ruto not to do that. On Sunday evening Ruto left for Hague a very shaken person. He called a press conference only when he was at the Hague, and informed the World that he will continue cooperating with the Court. This is said to have angered some revenge artists in the house on the Hill. They are said to have been swearing that though he escaped this time., next time he will not be soo lucky
