Badi you are not a lawyer so back off & dont give us your amateurish opinion. I quoted the application letter to Moi for one-acre plots by all 32 councillors and Moi wrote on the left side "approved" and signed it. I wrote the full list of councillors and even one NATION journalist (who had been in Mombasa then transferred) who benefitted from Miritini Settlement Scheme. I mentioned the number of plots allocated to Mayor Mwidani, Muhdhar, Khamis Nyundo & others.Then I had the confidential minute of the council approving the sale of Uhuru Gardens to Sajjad. Let him dare sue now for what he could not dare sue at that time and see how far he can get with it.

Everything I said about the Mayor & the plots is 100 percent true and I stand by it. One-acre plots were okayed by Moi for the 32 councillors to make them happy and stay in kanu. Hiyo siyo siri I am telling you. Maybe you were too young in 1995-96. The plots owned by the council were given to these diwanis and they are all recorded in Land Register.
Let him sue me if he can dare. What was true at that time and could not be sued remains true today and cannot be sued. Jai Ambe building near Municipal Stadium was a municipal council basketball field. Who sold it to the Asians ? What about the 14 Nyerere Avenue council flats ? The case was still in the courts a few years ago. What about Uhuru Gardens ? Ah, niwache. Give me a break with your utetezi.

The new constitution provides for private prosecution of all crimes dating back from 1963 and if Warsame has substantive evidence which can sustain his case against the former mayor Ahmed Muhdhar should make this historic move rather than remaining a free supplier of allegations against the persons he is opposed to. The newspaper cuttings Warsame purports to have written may not necessarily help as evidence. The fact he did write at the time and was not sued for libel does not guarantee him the audacity to continue spreading rumours of the yesteryears.

I condemn in the strongest terms the phone call made to Warsame for any purpose with regards to his blog through a proxy. Point to note is that Ahmed Muhdhar has a family to protect and intuitively we must all respect it. The most critical thing here is to look into who broke the law first and why. Social forums are enabling tools when used constructively but can be disastrous to unwise users as well. As Warsame was greatly generous to remind us of these watershed allegations,I believe it is only right to prove the same for the members to judge him fairly.

Ahmed Muhdhar is not a member of this forum nor are we sure that he can access the same information to defend himself though it is comprehensible as a public figure to be a subject of any relevant discourse which necessitates the dragging of his name but with respect and dignity required. In this case,Warsame needed to petition the nomination of the former mayor by an ODM party just like other citizens have done it in accordance with the law.

With the 'right of expression' comes the responsibility which we must all be prepared to take. One of the courses of 2007 PEV resulted from irresponsible utterances/expressions.

I have just received a threatening phone call from a close colleague of former Mayor Ahmed Muhdhar who told me to stop writing about the Mayor "or you will see." When I asked him if he was threatening me, he cut off and then called me again, this time to say the Mayor will tomorrow go and write a police statement to the effect that I called him a plot grabber.
I told him let him go ahead as I had all the evidence and I wrote it in the DAILY NATION at the time in 1995-96. During that time, former President Moi allowed each of the 32 councillors in the Mombasa MunicippalCouncil a 1-acre plot each. It led to the plunder of all council lands. Also Uhuru Gardens was sold to Rashid Sajjad.
Let the Mayor deny. I invite him and the police to come with me to the NATION Library where he will find the dettails in the newspapers of the time.
I am forwarding this to the Media Council of Kenya and the IEBC for noting.

IT was reported in today's Sunday Standard under the heading "ODM to reward loyalists with nominations" on page 5 that one of those whose name has been forwarded to the Elections Commission for nomination as ODM MP is none other than immediate Mayor of Mombasa, Ahmed Muhdhar.
Since nominated MPS are distributed regionally, it can only mean that ODM Mombasa pointman, Hassan Ali Joho, now seeking to be the Governor of the county in the coming elections, is the one who submitted Muhdhar's name to Raila and the ODM Elections Board, and they approved it with other names including Janet Ongera and forwarded them to the Commission.
We, as people of Mombasa, suffered for five years under the worst civic administration in its history headed by Muhdhar.
We do not want this man to be involved again in the affairs of Mombasa County. He has never stood for any elections, relying on three civic nominations and now a parliamentary one. In other words, this man cannot dare face the Mombasa electorate because he knows they will reject him.
It is said that Joho relies heavily on Muhdhar - whom he calls "father" - for advice. If so, then clearly Joho has nothing to offer the people of Mombasa with good leadership ideas. He must be bankrupt of ideas if Muhdhar is his political mentor.
What does Muhdhar know about solving Mombasa's complex problems ? As a media man, I know a tremendous lot about Muhdhar going back to the first time he became a councillor in 1992 when he led the plot grabbing of Mombasa Municipal Council that left the council without any land for development.
In 1995, I exposed in the Daily Nation all the plots that Muhdhar grabbed for himself and Rashid Sajjad who had made him a nominated councillor. Again, I also exposed the sale of the council-owned Uhuru Gardens to Sajjad, something in which Muhdhar played a key role.
I also reported that Muhdhar replaced Jaramogi Oginga Odinga Road name with Muhdhar Mohamedhabib - his grandfather - because the road led to Muhdhar's residence. When I confronted him, Muhdhar told me his grandfather was entitled to a road name because he was a freedom fighter, yet there is no way he could be compared to Jaramogi, nor is there evidence of this in history books,
Muhdhar was the lead man in anti-Raila campaign during the Kanu era. On becoming Mayor, in 2009, he built Sh 40m apartment building near VoK/Nyali. He also changed Kisauni Road to Raila Odinga Road - it is a route used by goat herders, full of goat droppings. Kisauni Road name plate was still there in January last year, four years after the name change.
Raila is reported in today's Press that he opposed Kibaki's nominations of Kaindi and Arachi as Deputies to Inspector General of Police and Muhoro as CID Boss because they had blemishes on their records, therefore cannot be entrusted with police reforms.
I am asking Raila the same question: How come you okay the nomination of Muhdhar as an MP to carry out your reform agenda ?
Is Muhdhar a right member of the reform team Raila wants to give us if he wins next March ? If so, please dont bother standing for President because we do not need that kind of people to lead us.
