[wanabidii] Mw, TZ border dispute: Government hopes for the best

Representatives of the governments of Malawi and Tanzania are expected
to submit a letter requesting for mediation to former Mozambique
president Joachim Chissano in Maputo today.

The two countries have agreed to give Southern Africa Development
Community (Sadc) forum for former heads of state up to March next
year, to resolve the ongoing Lake Malawi border dispute.

This is contained in a joint letter of request for mediation to the
Chairperson of the forum.

Malawi and Tanzania opted to engage former Sadc heads of state forum
to broker talks on the border wrangle, after a two day meeting between
representatives of the two governments held in Dar es Salaam in
November failed to reach an agreement.

"Both countries agree that the mediation process should not go more
than three months that is from January up to March 2013. The parties
don't want the matter to go on and on. So it is our hope that by March
the mediator would have presented its report on the matter.

"If nothing is achieved during that period then the matter will be
taken to the International Court of Justice (ICJ)," said Secretary for
Foreign Affairs Patrick Kabambe.

He explained that as the Chairperson of the forum, Chissano has been
given the discretion to appoint a panel of former presidents and other
relevant professionals to resolve the dispute.

Kabambe said the government of Malawi is confident that the matter
will be resolved amicably following the involvement of an independent
party in the matter.

He said currently a team of experts comprising officials from a number
of ministries and departments is working fulltime researching and
putting together relevant information to back Malawi's case.

He said so far the team has collected a lot of information that is
giving a lot of confidence and hope.

"I am personally very confident that we have a strong case. Surely
I'll be surprised if we lose this case," Kabambe said.

Among other things, Malawi is banking its hopes on the 1890 Anglo-
German Treaty also known as the Heligoland Treaty to back its claim of
the entire northern Lake Malawi.

The Malawi team also has a number of similar previous cases such as
the Cameroon and Nigeria dispute over the Bakassi Peninsula and the
Namibia/Botswana conflict over the Kasikili Island.

The Malawi/Tanzania dispute over Lake Malawi dates back to the 1960's.
